O presente trabalho analisa o juízo de admissibilidade da acusação no processo penal brasileiro com enfoque nas garantias constitucionais do contraditório e da ampla defesa. Para tanto, inicialmente foram estudados aspectos principiológicos a desenhar a base para a pesquisa desenvolvida. Destacado o caráter convencional das garantias apontadas e o procedimento como elemento indispensável ao conceito de processo penal, passouse ao estudo histórico da legislação embrionária, passando pelo Processo Criminal de Primeira Instância de 1832, Códigos de Processo Penal dos estados, até o atual Código de Processo Penal de 1941. Tal intento se deu para buscar as origens do instituto e relaciona-lo à antiga pronúncia inserida no seio de um procedimento penal bifásico. Por fim, buscou-se apontar o momento exato que se inicia o processo e que o sujeito tem seu status alterado perante o Estado, tornando-se assim acusado de um delito a ser verificado através de um processo penal justo. Confrontado o texto aprovado pela reforma de 2008, concluiu-se pela inconstitucionalidade do art. 396, do CPP e para solução desta problemática propõe-se a interpretação abrogativa do texto legal de modo a decotar a mesóclise "recebê-la-á". Aponta-se que somente desta forma haverá um juízo de admissibilidade da acusação constitucionalmente desenvolvido, podendo a decisão de recebimento da acusação ser proferida única e exclusivamente após o ingresso das razões defensivas iniciais

This paper analyzes the judgment about the accusation's admissibility in the brazilian´s criminal procedure with focus in the adversarial and full defense principles as constitutional guarantees. Therefore, it was initially studied principles to draw basis for the research developed. Highlighted the conventional nature of the guarantees indicated and the procedure as an indispensable element to the concept of criminal procedure the study passed on to a historical view of embryonic legislation passing through the 1832 Criminal Procedure Code of First Instance, states Criminal Procedure Codes, until the current 1941 Criminal Procedure Code. Such an attempt was made to search the origins of the probable cause decision institute and relate it in a biphasic procedure. Finally, it was sought to point out the exact moment that the criminal procedure begins and that the subject has his status changed before the State thus being accused of an offense to be verified through a fair criminal procedure. Faced with the text approved by the 2008' legal reform, it was concluded that CPP's 396 article is unconstitutional and to solve this problem is proposed the abrogative interpretation of the legal text in a way to remove the expression "will receive it". It is pointed out that only in this way will exists a judgment about the accusation's admissibility constitutionally developed. Finally, the probable cause decision only could be pronounced after the initial defensive reasoning registration.
