O presente trabalho tem o escopo de analisar, de forma crítica, a palavra do acusado e o seu tratamento durante a atividade probatória. O estudo foi realizado por meio do acurado exame da legislação nacional e estrangeira, bem como das posições dos mais diversos doutrinadores. A dissertação faz uma análise dos principais aspectos sobre a teoria geral da prova, da terminologia e da relevante distinção entre fonte de prova, meio de prova, elemento de prova e resultado probatório, na medida em que possibilita compatibilizar o processo penal acusatório com os poderes instrutórios do juiz. Também discorre sobre as declarações do imputado no direito inglês, no direito norte-americano e, principalmente, no direito italiano, que influenciou fortemente o processo penal brasileiro. Trata, também, dos institutos do interrogatório, do direito ao silêncio e da confissão e da possibilidade de se entender as declarações do acusado como fonte de prova pessoal. Finalmente, há especial atenção à colaboração premiada, mais especificadamente ao valor probatório que tem a declaração do agente colaborador e a possibilidade de ser ele fonte de prova.

The present work aims to critically analyze the accused's word and his treatment during the probationary activity. The study was carried out through an accurate examination of national and foreign legislation, as well as the positions of the most diverse indoctrinators. The dissertation analyzes the main aspects of the general theory of evidence, terminology and the relevant distinction between the source of evidence, the means of proof, the evidence and the evidential result, as it makes it possible to make the accusatory criminal process compatible with the powers the judge's instructions. It also discusses the statements of the accused in English law, in American law and, mainly, in Italian law, which strongly influenced the Brazilian criminal process. It also deals with the institutes of interrogation, the right to silence and confession and the possibility of understanding the accused's statements as a source of personal evidence. Finally, special attention is paid to the award-winning collaboration, more specifically to the evidential value of the collaborating agent's statement and the possibility of being a source of evidence.
