O presente trabalho tem a finalidade de estabelecer os elos da cadeia de custódia da perícia de identificação por DNA e as consequências resultantes da sua inobservância. Para atingir esse objetivo, ao longo da pesquisa foram trabalhados os conceitos relacionados à prova pericial em geral, o seu tratamento legal e as especificidades do contraditório para esse meio de prova. Na sequência, foram desenvolvidas as questões essenciais relacionadas à cadeia de custódia, incluindo a sua conceituação, pressupostos, requisitos, elos, ônus de registro, limites e tratamento legal. A partir disso, passou-se a analisar as consequências que a quebra da cadeia de custódia tem na admissibilidade da prova, estabelecendo os critérios a serem verificados, em cada caso, para definir se a falta dos registros que autenticam a identidade e a integralidade do elemento ou fonte de prova impedem a sua entrada no processo ou se essas lacunas devem ser consideradas no momento de valoração da prova pelo juiz. Por fim, ao abordar as principais questões genéticas e técnicas relativas à perícia de identificação por DNA, aplicou-se a essa atividade probatória os conceitos e conclusões anteriormente estabelecidos sobre a cadeia de custódia e as consequências da sua quebra.

The purpose of this document is to establish links in the chain of custody for DNA identification expertise and the consequences arising from it being disregarded. To reach this objective, the research touched on concepts related to overall expert evidence, its legal approach and the specifics on the adversarial procedure for this method of proof. Next, fundamental issues related to the chain of custody were explored, including its conceptualization, assumptions, requirements, links, burden of records, limits and legal framework. From this point forward, an analysis was performed on the consequences that the breach of the chain of custody has on the admissibility of the evidence, determining the criteria to be verified in each case in order to define whether the lack of the records that authenticate the identity and the completeness of the element or source of evidence precludes it from being admitted into the case or whether these deficiencies should be considered at the time the judge assesses the evidence. Lastly, by addressing the key genetic and technical issues related to DNA identification expertise, the concepts and conclusions previously established concerning the chain of custody and the consequences of its breakdown were applied to this evidentiary activity.
