O tema da convencionalidade em matéria processual ganhou novos espaços de debate com a edição do Código de Processo Civil vigente. A permeabilidade do Processo Civil à atuação do autorregramento da vontade das partes exige o equilíbrio entre o publicismo processual e a autonomia privada, para que a celebração de convenções processuais alcance o objetivo de racionalizar o processo e torná-lo mais eficiente aos cidadãos a partir da atuação cooperativa entre os sujeitos processuais. Para tanto, interessa compreender como se dão as interações entre a atuação jurisdicional e as convenções processuais no contexto do Processo Civil democrático no Brasil. Pela relevância teórica e prática do tema no campo do direito probatório, o recorte metodológico traçado para a pesquisa é o das convenções processuais em matéria de prova. Nesse âmbito, a dificuldade para delimitar os espaços de convivência entre as convenções processuais em matéria de prova e os poderes instrutórios constitui o problema desta pesquisa. A partir dele, objetiva-se compreender como acontecem as interações entre as convenções processuais probatórias e os poderes instrutórios para identificar se aquelas têm aptidão para a limitar a iniciativa probatória do órgão jurisdicional. A pesquisa está alicerçada primordialmente na natureza publicista do sistema processual brasileiro; na opção legislativa de atribuir ao juiz poderes instrutórios amplos e independentes da atuação das partes e nas diretrizes cooperativa e de eficiência inerentes ao Processo Civil democrático e reafirmadas pelo Código de Processo Civil de 2015. Assentadas as premissas, examina-se, primeiramente, a ampliação do fenômeno da consensualidade relativamente ao litígio e ao processo, especialmente nos séculos XX e XXI, enfocando o exame ao Direito Processual cada vez mais permeável à atuação da vontade das partes. Num segundo momento, por meio de revisão bibliográfica correspondente, analisa-se a categoria dos negócios jurídicos aplicada ao Direito Processual Civil, focando nos seus aspectos conceituais e teóricos, que respaldam o reconhecimento de sua viabilidade e utilidade nesse ambiente. Realiza-se, ainda, um estudo do modelo de negociação processual estabelecido pelo Código de Processo Civil, com vistas a fornecer os elementos necessários à compreensão do fenômeno em relação à matéria probatória. Delimitada a análise às convenções - ou seja, os negócios jurídicos processuais bilaterais ou plurilaterais -, apresenta proposta ampliativa para a identificação de convenções processuais probatórias tendo como critério a utilidade à regulação direta ou indireta de situações processuais ou procedimentos relativos à fase instrutória. A partir disso, investiga-se a aptidão das convenções processuais probatórias à limitação do exercício de poderes instrutórios pelo juiz, com base no modelo de vinculação operada segundo as posições assumidas pelo órgão jurisdicional frente às convenções processuais probatórias, como parte ou terceiro (inclusive nas situações excepcionais de homologação da convenção). Com base na análise específica de cada uma das convenções processuais probatórias identificadas na pesquisa, são apontadas situações de possibilidade e impossibilidade de limitação legítima aos poderes instrutórios do juiz.

The subject of the agreement of the parties in procedural matters acquired new spaces for debate with the issue of the current Code of Civil Procedure. The permeability of the Civil Procedure to the self-regulating action of the parties' will requires a balance between the procedural public nature and the private autonomy, so that the procedural agreements attains the purpose of rationalizing the process and making it more efficient to the people, based on the cooperation between the process parties. For that purpose, it is important to understand how the interactions between the court action and the procedural agreements take place in the context of the democratic Civil Procedure in Brazil. Due to the importance in theory and in practice of this subject in the field of evidence law, the methodological option made for the research is that of procedural conventions in the field of evidence. In this area, the difficulty to limit the spaces between the procedural agreements in the matter of evidence and the fact finding authority of the judge is the problem of this research. Based on that, the purpose is to understand how the interactions between the procedural agreements in matter of evidence and the fact finding authority take place, in order to identify if the first are qualified to limit the evidence finding initiative of the court. The research is based essentially on the public nature of the Brazilian procedural system; on the positive law option to give broad fact finding authority to the judge, independent from the action of the parties, and on the cooperation and efficiency guidelines inherent to the democratic Civil Procedure and reasserted by the 2015 Code of Civil Procedure. Once the premises are established, it examines the extension of the consensuality phenomenon as regards the litigation and the process, in particular in the 20th and 21st centuries, with a focus on examining the Procedural Law that is increasingly permeable to the will of the parties. In a second moment, by means of the corresponding bibliographic review, an analysis is done of the legal transactions applied to the Law of Civil Procedure, with an emphasis on the conceptual and theory aspects which back the acknowledgment of their feasibility and usefulness in this area. A study of the procedural negotiation model found in the Code of Civil Procedure is performed, so as to supply elements necessary to understand this fact as regards evidence finding. The analysis limited to the agreements - that is, the bilateral or multilateral procedural legal transactions - an enlarging proposition is made to identify the evidence procedural agreements from the point of view of the usefulness to the direct or indirect regulation of procedural situations or proceedings related to the fact finding stage. Based on that, an inquiry is made of the capacity of the evidence procedural agreements to limit the fact finding authority of the judge, based on the model of the link existing according to the positions taken by the court as regards the evidence procedural agreements as party or as third party (including the exceptional situations when the agreement is court approved). Based on a specific review of each of the evidence procedural agreements identified in the research, it points to situations of possibility and impossibility to a legitimate limitation to the judge's fact finding authority.
