O presente estudo tem como objetivo analisar o controle da obtenção e admissibilidade de elementos de informação no Processo Penal brasileiro. A partir dessa delimitação, escolheuse como ponto de partida a ligação entre epistemologia judiciária naquilo que se aproxima da possibilidade de se atingir a aceitável correspondência entre o evento passado e o que é dado a conhecer pelo juiz, bem como o reconhecimento de que a conformação de cada sistema processual penal atende a alguma opção de política criminal. Essas premissas permitiram que primeiro se cuidasse de aspectos conhecidos na origem da separação entre sistemas processuais penais, ora apegados ao modelo de common law, ora ao de civil law, para se perceber que, atualmente, os institutos probatórios revelam certa clivagem, tornando essa separação menos relevante, particularmente com o advento de regras probatórias específicas de tribunais internacionais e do sistema convencional como um todo, mas ainda em torno de sistemas probatórios. Na sequência são discutidas questões do procedimento probatório e das peculiaridades que pareceram dignas de nota no processo penal tanto brasileiro quanto italiano, para, então, se avançar no chamado "léxico das provas"; isto é, em capítulos distintos, cuidou-se ora da dinâmica probatória (o procedimento), ora de seus aspectos estáticos (as categorias probatórias). Enquanto a reflexão sobre o procedimento se mostrou importante para a compreensão de fases do fenômeno probatório, aquela sobre as categorias probatórias permitiu a formulação de juízos críticos pontuais. Em seguida, foram analisados alguns contextos cuja comparação com o modelo brasileiro vigente pareceu útil - destacadamente, o modelo italiano e suas particularidades -, e sistemas latino-americanos, a partir da década de 1980, inclusive com a tentativa de uniformização, advinda do Código Modelo para a Ibero América. A pesquisa não deixou de contemplar, também, as particularidades dos sistemas probatórios mais relevantes. E foi a partir dessa perspectiva que, com o olhar novamente voltado para o cenário brasileiro, percebeu-se a longa duração de um sistema probatório que, conquanto tenha sofrido alterações pontuais, peca por não evoluir no sentido de observância, seja de fase específica de controle de obtenção e admissibilidade de provas no Processo Penal, seja no controle específico a depender de eventual categoria probatória que isso justifique. No Brasil, malgrado se tenha sugerido, sem sucesso, a fase de "saneamento" no Processo Penal, mesmo que se tenha imaginado o que poderia ser uma fase própria de recebimento de acusações, ainda não se observa evolução no sentido de estabelecimento de regras para o controle da obtenção e admissibilidade de informações no Processo Penal. Por tudo isso é que no último capítulo foram aventadas algumas alterações, calcadas tanto na deficiência histórica nacional como na visão que foi possível alcançar com o suporte de exemplos de países culturalmente próximos do Brasil. Foram sugeridas ideias como Juiz de Garantias, delimitação de competência, exclusão física de determinadas informações dos autos, previsão de fase específica de controle de obtenção e admissibilidade de informações - como regra geral, sem prejuízo de oportunidades tópicas para o referido controle, a depender da categoria probatória. Também, no capítulo final, chegou-se à proposição de alterações legislativas, a partir da noção de filtro epistemológico, que foi naturalmente ganhando corpo ao longo da desta pesquisa. Do início ao fim, cogitouse como tema da pesquisa um melhor funcionamento do direito probatório no Processo Penal brasileiro, da perspectiva do controle que pode ser exercido com vistas ao que pareceu ser uma adequada concepção político-criminal de Processo Penal e que não frustre as expectativas epistemológicas de melhor conhecer o evento passado para que se possa julgá- lo.

The present study aims at analysing the control on the obtainment and admissibility of information elements in the Brazilian criminal procedure system. Under such boundaries, the choice was made to start from the connection between judicial epistemology in what it is close to the possibility of reaching an acceptable correspondence between the past event and what is disclosed by the judge, as well as the acknowlegment that the configuration of each criminal procedural system satisfies a given option of criminal policy. With these premises in mind, it was possible first to tackle some known aspects in the origin of the separation between criminal procedural systems, now clung to the common law model, now clung to the civil law model, only to show that, currently, the probative systems show a certain severance thus rendering this separation less relevant, especially with the advent of probative rules that are specific to international courts and the conventional system as a whole, but still around probative systems. In the sequence, this study discusses aspects of the probative procedures and peculiarities that seemed worth noting both in Brazilian and the Italian criminal procedures, after which the so-called "lexicon of the proof" was addressed; i.e., in discrete chapters, discussions were conducted now about the probative dynamics (the procedure), now about its static aspects (the probative categories). While the reflection about the procedure showed its relevance to an understanding of the phases of the probative phenomenon, that one about the probative categories enabled the formulation of specific critical judgments. The next step was the analysis of some contexts, in which a comparison with the current Brazilian model seemed to be useful - especially the Italian model and its peculiarities - and Latin-American systems starting from the decade of 1980, including the attempt at an standardisation arising from the Código Modelo para Ibero América [Model Code for Iberian America]. In addition, the present research has examined the particularities of the most relevant probative systems. And it was from this perspective that, by looking again into the Brazilian scenario, it was possible to notice the long duration of a probative system which, despite having undergone certain changes, errs by not evolving in the sense of observance, whether it is in the specific phase of control on the obtainment and admissibility of evidence in the penal procedure, whether it is in the specific control, depending on the possible probative category that may justify it. In Brazil, despite unsuccessful suggestions of a 'sanitation" phase in the criminal procedure system - or even if what could be the very phase for receiving accusations has been envisioned - there is still no clear sign of advance in the sense of establishing rules to control obtainment and admissibility of information in the Brazilian criminal procedure system. It is on all these grounds that in the last chapter, some alterations were suggested, modelled both on the historical national deficiency and on the view it was possible to take with the support of examples of countries that are culturally akin to Brazil. Suggestions have been given concerning ideas such as guarantee judges, delimitation of jurisdiction, physical exclusion of certain pieces of information in the records, forecasting of a specific phase of control on the obtainment and admissibility of information - as a general rule, without prejudice to topical opportunities for said control, depending on the probative category.The closing chapter also puts forwards some propositions about legislative changes based on the notion of epistemological filter, which naturally took shape in the course of the present study. From beginning to end, the theme of this research emerged from the cogitation that there might be a better functioning of probative law in the Brazilian criminal procedure system from the point of view of the control that can be exercised aiming at what seemed to be an adequate political and criminal notion of criminal procedure and which does not thwart the epistemological expectations of better knowing the past event in order to evaluate it.
