O objetivo maior do presente trabalho consiste na exposição analítica do juízo de admissibilidade e do juízo de adstrição dos recursos especial e extraordinário, ou seja, dos mecanismos de contenção de acesso ao Supremo Tribunal Federal e ao Superior Tribunal de Justiça conferidos pelo sistema processual brasileiro, na atualidade, especialmente às presidências ou às vice-presidências dos tribunais de apelação. Partindo-se da evolução histórico-legislativa de mecanismos do gênero desde a instauração da República, examinamse os pontos mais destacados ou controvertidos dos regimes jurídicos desses mecanismos, individualizando-os a partir de conceitos sugeridos para ambos, a fim de se compreender que se trata de atividades cognitivas distintas, submetidas, assim, a particularidades em sua disciplina jurídica. Para além de distintas, busca-se demonstrar que se trata de atividades compossíveis em uma mesma relação processual, buscando-se, então, sistematizar a maneira pela qual a coexistência dessas atividades deve ser harmonizada, a fim de que o bom manejo desses mecanismos pelos órgãos judiciários por eles responsáveis possa conferir funcionalidade aos tribunais superiores, razão maior para o estabelecimento desses mesmos juízos.

The main objective of the present essay consists of the analytical exposition of the juízo de admissibilidade (admissibility judgement) and the juízo de adstrição (binding judgement) of the recurso especial (special appeal) and the recurso extraordinário (extraordinary appeal). These judgements consist of access containment mechanisms to the Brazilian Supreme Court (Supremo Tribunal Federal) and the Superior Court of Justice (Superior Tribunal de Justiça), both conferred by the Brazilian procedural system, nowadays, especially to the presidencies or vice-presidencies of the courts of appeal. Starting from the historical and legislative evolution of this kind of mechanism since the establishment of the Brazilian Republic, it will be examined the most highlighted or controversial points of the legal regimes of these mechanisms, individualizing them starting from concepts suggested for both, in order to demonstrate that these judgements are distinct cognitive activities, thus subject to particularities in their legal discipline. In addition to being distinct, it will be demonstrate that these judgements are compossible activities in the same procedural relationship, seeking, then, to systematize in a way in which the coexistence of these activities must be harmonized, in order to promote functionality to the higher courts, the major reason for establishing these judgements.
