A tese tem por objetivo demonstrar a amplitude dos poderes do juiz relativamente ao controle dos negócios jurídicos processuais, que não se restringe aos pronunciamentos sobre a validade desses atos jurídicos. A partir da premissa de que há três planos sobre os quais se pode compreender o fato jurídico, busca-se demonstrar que o magistrado pode decidir sobre a existência, a validade e a eficácia dos atos negociais, sejam unilaterais, sejam plurilaterais. A hipótese a ser demonstrada defende a existência de um microssistema de controle dos negócios jurídicos processuais, construído a partir do parágrafo único do art. 190, do CPC, cuja interpretação lógico-sistemática permite aglutinar o sistema de invalidades processuais a outros dispositivos do Código de Processo Civil que permitem controle de questões prévias, como a inexistência do negócio, e questões decorrentes da necessidade de preservação dos atos processuais, que impactam no plano da eficácia. Para efetivação dos poderes de controle, busca-se demonstrar que há procedimentos específicos, incidentais ou não, destinados a permitir ao juiz realizar o controle dos negócios jurídicos processuais em quaisquer dos planos do fato jurídico. Em cada um desses procedimentos, exige-se a construção de decisão adequada ao controle, com fundamentação que externe, adequadamente, os motivos pelos quais a autonomia negocial das partes não teve o poder de produzir os efeitos pretendidos.

The thesis aims to demonstrate the extent of the judge's powers regarding the control of procedural contracts, which is not restricted to pronouncements on the validity of such legal acts. Based on the premise that there are three planes on which the legal event may be understood, it seeks to demonstrate that the magistrate may decide on the existence, validity and effectiveness of transactional acts, whether unilateral or plurilateral. The hypothesis to be demonstrated defends the existence of a micro-system of control of the procedural contracts, constructed from the sole paragraph of article 190 of the CPC, whose logical-systematic interpretation allows the agglutination of the system of procedural invalidity to other provisions of the Code of Civil Procedure that allow control of previous issues, such as the inexistence of the contract, and issues arising from the need to preserve the procedural acts, which have an impact on the level of effectiveness. In order to enforce the control powers, it is sought to demonstrate that there are specific procedures, incidental or not, intended to allow the judge to perform the control of the procedural contracts in any of the planes of the legal event. In each of these procedures, the construction of an adequate decision is required for the control, with grounds that adequately extinguish the reasons why the negotiating autonomy of the parties did not have the power to produce the intended effects.
