A prova emprestada é uma técnica processual de reaproveitamento de provas entre processos distintos. Suas principais finalidades são, de um lado, evitar a repetição de atividade probatória já validamente realizada e, de outro, permitir que fontes de prova inexistentes possam ser utilizadas pelas partes de um processo em curso, resguardando o direito constitucional à prova e contribuindo para a formação do convencimento do julgador do processo de destino. Já admitida como espécie de prova atípica sob a égide de codificações processuais anteriores, a prova emprestada recebeu tratamento legal expresso no Código de Processo Civil vigente (lei federal n. 13.105, de 16 de março de 2015), cujo art. 372 prevê que o juiz poderá admitir a utilização de prova produzida em outro processo, atribuindo-lhe o valor que considerar adequado, observado o contraditório. Partindo da inovação legislativa, a presente dissertação se propõe a apresentar um estudo sistematizado da técnica da prova emprestada analisando seu conceito, natureza jurídica, fundamentos constitucionais, forma de ingresso e de produção no processo de destino, requisitos de admissibilidade e valoração pelo juízo destinatário para, ao final, examinar questões atuais envolvendo o empréstimo de provas no direito processual civil pátrio.

Borrowed evidence is a procedural technique for reusing evidence between distinct proceedings. Its main purposes are, on the one hand, to avoid the repetition of evidential activity already validly performed and, on the other hand, to allow non-existent sources of evidence to be used by the parties of a proceeding in progress, safeguarding the constitutional right to evidence and contributing to the formation of the conviction of the judge of the target proceeding. Already admitted as a type of atypical evidence under the aegis of previous procedural codifications, borrowed evidence received express legal treatment in the current Code of Civil Procedure (Federal Law No. 13.105 of March 16, 2015), whose article 372 provides that the judge may admit the use of evidence produced in another proceeding, giving it the value he deems appropriate, with due regard for the adversarial principle. Based on the legislative innovation, this dissertation proposes to present a systematic study of the borrowed evidence technique analyzing its concept, legal nature, constitutional foundations, form of entry and production in the target proceeding, admissibility requirements and valuation by the recipient court to finally examine current issues involving the borrowing of evidence in Brazilian civil procedural law.
