Ao analisar a incidência do Princípio do Juiz Natural no Processo de Execução Penal, é possível identificar a importância de outras normas constitucionais neste processo. Assim, as regras de competência do processo de execução penal têm que ser compatibilizadas com outros valores expressos no ordenamento jurídico brasileiro, em uma interpretação com base na ponderação dos direitos em conflito, sempre preservando, o mínimo, de cada qual. Imperioso o desenvolvimento de novos instrumentos jurídicos para criação de um processo de execução penal mais célere e humanizado, com a necessária diminuição da superlotação carcerária.

Abstract in English
When analyzing the incidence of the Principle of the "Natural Judge" into the criminal sentence enforcement process is possible to identify the importance of others constitutional norms in this process. Thus, the jurisdiction rules in the criminal sentence enforcement process must be reconciled with the others values expressed in the Brazilian legal framework, in an interpretation based on the weighting of conflicting rights, always preserving the minimum of each one. Compelling the creation of a new legal instruments for development for a faster and more humane criminal sentence enforcement process, with the necessary reduction of prison overcrowding.
