O presente estudo aborda, de forma crítica, os diversos aspectos processuais da tutela jurisdicional executiva contra a Fazenda Pública. O objetivo geral é investigar e sistematizar a respectiva técnica processual à luz da garantia constitucional da efetividade do processo, um dos corolários sacros da cláusula do devido processo legal. Para tanto, são analisadas as várias peculiaridades que compõem o atual e intrincado cenário das regras constitucionais do regime diferenciado de pagamento dos débitos fazendários reclamados em juízo. O escopo específico é demonstrar que as normas regentes da denominada execução por precatório não comportam mais interpretações transigentes com interesses fazendários que portem a indesejável consequência de retardar ilimitada ou desarrazoadamente a realização material do direito do credor. O advento do Código de Processo Civil de 2015 confirma, em vários aspectos, essa assertiva. O estudo examina também, de forma adjacente, questões relativas à efetividade da tutela jurisdicional executiva direcionada às denominadas obrigações específicas em face da Fazenda Pública.

This study critically addresses the various procedural aspects of executive judicial protection against the Public Treasury. The general objective is to investigate and systematize the respective procedural technique in light of the constitutional guarantee for the effectiveness of the proceeding, one of the sacred corollaries of the due process of law. In order to do so, I analyzed the various peculiarities that make up the current and intricate scenario of constitutional rules of the differentiated scheme of payment of estate treasury debts demanded in court. The specific scope is to demonstrate that the regulative norms of the so-called enforcement by registered warrant (IOU issued by the judiciary branch [precatório]) do not accept any more compromising interpretations with state treasury interests that carry the undesirable consequence of unlimitedly or unreasonably delaying of the material realization of a creditor's right. The advent of the Civil Procedure Code of 2015 confirms this assertion in several respects. The study also examines, in an adjoining way, questions related to the effectiveness of the executive judicial protection directed to the so-called specific obligations in face of the Public Treasury.
