Os acordos de colaboração premiada podem resultar em uma série de benefícios para aqueles que decidem colaborar com as investigações e processos criminais, dentre os quais a imunidade. Trata-se de um benefício processual, por meio do qual o órgão acusador se compromete a não dar início a um processo criminal contra o colaborador. Se o acordo for efetivamente cumprido, o benefício poderá produzir efeitos materiais, evitando que o colaborador seja punido por seus crimes. A análise histórico-comparada permite identificar as raízes do instituto e as justificativas para a sua utilização, tanto na tradição romano-germânica quanto no common law, com o objetivo de facilitar a compreensão sobre as discussões a respeito no cenário internacional atual. A partir disso, podem ser apontadas as principais influências exercidas para a formação deste cenário e os reflexos que essas discussões produziram na legislação brasileira sobre o tema. Podem ser verificadas as justificativas utilizadas para a incorporação do instituto ao ordenamento jurídico brasileiro, observando-se como a colaboração premiada vem sendo utilizada deste então. Como a imunidade é algo relativamente recente no Brasil, dá ensejo ao estudo de sua conformidade constitucional, passando pelos aspectos processuais referentes à formalização dos acordos e aos seus efeitos na esfera judicial. Ao final, são destacadas as principais distinções entre a imunidade e outros institutos previstos no ordenamento jurídico brasileiro. A colaboração premiada no Brasil, como em outros lugares e momentos históricos, também se justifica em função de uma suposta necessidade, que disfarça uma opção utilitária. Será possível constatar que a disciplina aplicável aos acordos de imunidade não viola a Constituição Federal, mas precisa ser aperfeiçoada para que a utilização do instituto, na prática, não resulte na violação de direitos e garantias fundamentais.

Accomplice's cooperation agreements can result in several benefits for those who choose to collaborate with criminal investigations and prosecutions, such as the immunity. This is a procedural benefit whereby the prosecutor undertakes to not initiate criminal proceedings against the accomplice who collaborates. If the agreement is effectively fulfilled, the benefit may have material effects, preventing this accomplice from being punished for his crimes. The historical-comparative analysis allows us to identify the institute's roots and the justifications for its use, both in the roman-germanic tradition and in the common law, to facilitate the understanding of the discussions about it in the current international scenario. From this, the main influences exerted for the formation of this scenario and the reflections that these discussions produced in the Brazilian legislation on the subject can be pointed out. The justifications used for the incorporation of the institute into the Brazilian legal system can be verified by observing how the accomplice's cooperation has been used since then. As immunity is relatively recent in Brazil, it allows the study of its constitutional conformity, going through the procedural aspects related to the formalization of the agreements and their effects in the judicial sphere. In the end, the main distinctions between immunity and other institutes provided for in the Brazilian legal system are highlighted. The accomplice's cooperation in Brazil, as in other places and historical moments, is also justified due to an alleged need, which disguises a utilitarian option. It will be possible to verify that the discipline applicable to immunity agreements does not violate the Federal Constitution but needs to be improved so that the use of the institute, in practice, does not result in the violation of fundamental rights and guarantees.
