Nessa dissertação buscou-se a existência de fatores determinantes para a vinculatividade de precedentes judiciais. A pesquisa partiu de um método dogmático para a investigação da existência desses fatores no novo Código de Processo Civil brasileiro, encontrando em seu curso estudos estrangeiros e nacionais nos campos da teoria geral do Direito e da filosofia do Direito ricos na identificação daqueles fatores, embora a doutrina processual já tivesse mencionado a existência de alguns fatores sem muita profundidade. Foi possível identificar uma série de fatores determinantes para a vinculatividade dos precedentes judiciais, mas não foi possível encontrar uma fórmula para auxiliar na avaliação em concreto do peso dos precedentes nos sistemas jurídicos. Ainda assim, foi possível perceber que, no caso do direito brasileiro, ao menos em seu estágio atual, as normas de direito positivo podem ser o primeiro fator, em um primeiro nível de análise, para a determinação da vinculatividade dos precedentes judiciais.

In this dissertation the existence of factors to the bindingness of judicial precedents was seek. This research was based on a dogmatic method for investigating the existence of these factors in the Brazilian Civil Procedure Code, finding on its foreign and national studies in the fields of the general theory of law and the philosophy of law rich in the identification of those factors, although civil procedure studies had mentioned the existence of some factors without much depth. It was possible to identify many factors to the bindingness of judicial precedents, but it was not possible to find a formula to assist in the evaluation of the weight of judicial precedents in the legal systems. Nevertheless, it was possible to perceive that, in the case of Brazilian law, at least in its current stage, the positive law may be the first factor, in a first level of analysis, to determine the bindingness of judicial precedents.
