Inseridas em um contexto de ampliação do acesso à justiça, as ações coletivas foram paulatinamente inseridas no ordenamento brasileiro, tendo como inspirações sistemas estrangeiros, mas com um traço reconhecidamente inovador na construção de um sistema próprio. Para além da previsão de possibilidade de recepção das demandas coletivas, a estrutura judicial e seus institutos acabaram por se alterar diante dos novos panoramas que foram inaugurados com a introdução e reconhecimento da tutela judicial dos direitos e interesses transindividuais. Assim, se impõe como um desafio explorar como os institutos processuais clássicos se amoldaram para além da relação processual individual incialmente estabelecida e para a qual a maioria dos institutos foram idealizados e o reflexo desta alteração sobre os sujeitos jurídicos processuais, com foco na figura do juiz. Para tanto, o presente trabalho se deteve na construção dos conceitos de sujeitos jurídicos processuais e da relação jurídica processual como bases para definição particular conferida à seara processual coletiva e os reflexos que essa alteração desencadeia junto às responsabilidades inerentes ao papel do juiz, como figura imparcial, no desempenho de seus poderes-deveres.

Inserted in a context of increasing access to justice, collective actions were gradually inserted into the Brazilian system, inspired by foreign systems, but with a recognizably innovative trait in the construction of a system of its own. In addition to anticipating the possibility of receiving collective demands, the judicial structure and its institutes eventually changed in the face of the new scenarios that were inaugurated with the introduction and recognition of judicial protection of transindividual rights and interests. Therefore, it is a challenge to explore how the classic procedural institutes were shaped beyond the individual procedural relationship initially established and for which most of the institutes were idealized and the reflection of this change on the juridical subjects procedural, focusing on the figure of the judge. In order to do so, the present work focused on the construction of the concepts of procedural legal subjects and the procedural legal relationship as bases for a particular definition given to the collective process and the reflexes that this change brings together with the responsibilities inherent to the role of the judge as an impartial figure, in the performance of his powers-duties.
