Com o advento das mudanças do Código de Processo Civil pela Lei 13.105/2015, posições doutrinárias foram adotadas pelo legislador. Objetiva-se analisar as diversas correntes quanto à devolução da matéria ao órgão ad quem por meio do recurso de apelação. Efetuou-se, então, a análise da abrangência e limite da sentença e da atuação do órgão ad quem quando provocado, utilizando-se estudo da legislação atual e anterior, nacional e estrangeira, e com uso de metodologia de pesquisa bibliográfica. Analisaram-se a formação dos capítulos de sentença, o duplo grau de jurisdição, o conteúdo do recurso de apelação e a autonomia do órgão ad quem na análise recursal. Constataram-se a existência de diversas correntes quanto aos assuntos abordados e a falta de adoção de um único posicionamento pelos Tribunais. Concluiu-se a necessidade de renovação da interpretação e efetivação do efeito devolutivo em sua extensão e profundidade.

Lawmakers adopted doctrinal positions after the changes in the Code of Civil Procedure by law number 13.105/2015. The objective herein is to analyze the many currents regarding the return of the matter to the Superior Court through the appeal. The analysis of the scope of the sentence and the Superior Court's interaction when provoked was carried out, using a study of the current and previous, national and foreign legislation and using a bibliographic research methodology. The sentence chapters formation, the jurisdiction double degree, the appeal content and the Superior Court's autonomy in the review process were then analyzed. There were several currents on the addressed issues and a lack of adoption of a single position by the Courts. It was concluded that one needs considerate a new interpretation and higher performance of the devolutive effect in its extension and depth.
