O tema da presente dissertação é a infiltração policial e a investigação da criminalidade organizada. O objetivo principal da pesquisa é a fixação de limites constitucionais, racionais e sistêmicos para o emprego da infiltração de agentes, indispensáveis à manutenção do equilíbrio entre garantismo e eficiência, bem como à legitimidade da própria medida investigativa. Para esse intuito, inicia-se a exposição com o estudo da criminalidade organizada, com suas características peculiares, que impulsionaram o desenvolvimento de técnicas especiais de investigação, bem assim com as discussões a respeito dos limites à busca da verdade no processo penal, que orientam a persecução em um Estado Democrático de Direito. Na sequência, aprofunda-se a análise específica da infiltração de agentes, estabelecendo o seu encaixe teórico e os motivos pelos quais serve à persecução penal relacionada à criminalidade organizada, assim como discute-se os direitos fundamentais que entram em conflito quando é adotada na investigação criminal. A partir dessas premissas, apresenta-se algumas experiências estrangeiras com as operações encobertas e de infiltração, a fim de examinar o tratamento conferido a essas medidas em outros ordenamentos jurídicos, o que será utilizado como parâmetro para sugestões de alterações legislativas. Por fim, desenvolve-se as críticas ao regime jurídico da infiltração policial estabelecido na Lei nº 12.850/13, apontando as lacunas e contradições da legislação, e propõe-se limites para o emprego desse instrumento com respeito aos direitos e garantias fundamentais dos cidadãos.

The theme of this dissertation is police infiltration and the investigation of organized crime. The main objective of the research is the establishment of constitutional, rational, and systemic limits for the use of undercover agents, indispensable to maintain the balance between guaranteeism and efficiency, as well as the legitimacy of the investigative measure itself. For this purpose, the exposition begins with the study of organized crime, with its peculiar characteristics, which boosted the development of special investigation techniques, as well as discussions regarding the limits to the search for truth in criminal proceedings, which guide the pursuit of a democratic state of law. Subsequently, the specific analysis of the undercover agents is deepened, establishing its theoretical fit and the reasons why it serves the criminal prosecution related to organized crime, as well as discussing the fundamental rights that conflict when it is adopted in the criminal investigation. Based on these premises, some foreign experiences with undercover operations and agents are presented, in order to examine the treatment given to these measures in other legal systems, which will be used as a parameter for suggestions for legislative changes. Finally, critiques to the legal regime of police infiltration established in Law nº 12.850/13 are made, pointing out the gaps and contradictions in the legislation, and proposing limits for the use of this instrument with respect to the fundamental rights and guarantees of citizens.
