O Poder Judiciário brasileiro tem se deparado com a instauração cada vez mais recorrente de incidentes processuais em ações judiciais relacionadas à insolvência empresarial, para apuração de fraude contra credor, em seu sentido amplo, inclusive quando os ilícitos praticados pelo devedor e seus partícipes têm reflexos em jurisdições estrangeiras. Procurouse demonstrar que em tais incidentes há o efetivo exercício autônomo à prova, permitindose inclusive que se possa ter a compreensão da viabilidade ou não da propositura de medidas indenizatórias, revocatórias, entre outras, para se atingir o objetivo final de arrecadação de ativos para pagamentos dos credores da empresa em insolvência, nos termos da previsão contida no inciso III, do artigo 381 do Código de Processo Civil. Sustentou-se que tais incidentes estariam enquadrados em uma espécie atípica de produção antecipada da prova e que neles é possível o exercício pleno e amplo do direito à investigação, que está inserido no direito autônomo à prova. Em razão dos múltiplos interesses envolvidos, sustentou-se que o direito à investigação relacionado ao processo concursal empresarial possui prerrogativas mais fortes e excepcionais que um processo cível comum em que litigam apenas partes opostas no polo passivo e ativo, sendo possível, em alguns casos, o sigilo na investigação realizada. Foram abordadas, por fim, medidas específicas para a obtenção de provas em jurisdições estrangeiras, em especial nos países que adotam o sistema de common law. Em todo trabalho há uma abordagem recorrente e necessária sobre a jurisprudência nacional e estrangeira.

The Brazilian Judiciary has increasingly witnesses the commencement of incidental proceedings under corporate insolvency applications, with the purpose of investigating fraud against the creditors (in its broadest sense) even when the wrongdoings committed by the debtor and its accomplices lead to consequences in foreign jurisdictions. This study sought to demonstrate that in such incidental proceedings there is an effective exercise of an autonomous right to prove, thereby allowing one to understand the feasibility of proposing indemnity measures, avoidance actions, among others, to achieve the ultimate goal of collecting assets for the payment of the creditors of the insolvent company, pursuant to the provisions contained in item III of article 381 of the Code of Civil Procedure. This study further argued that such incidental proceedings would be characterized as an atypical type of early production of evidence, under which it is possible to exercise the full and broad right to investigate, which is part of the autonomous right to prove. Due to the multiple interests involved, this study also argued that the right of investigation arising from an insolvency proceeding has stronger and exceptional prerogatives in comparison with typical civil proceedings in which only opposing parties litigate as claimants and defendants, it being possible, in some instances, to perform investigations under judicial secrecy. Finally, this study reviewed specific measures for obtaining evidence in foreign jurisdictions, especially in countries that adopt the common law system. In the study as a whole, there is a recurrent and necessary approach to national and foreign jurisprudence.
