No contexto de massificação das relações jurídicas e afloramento da litigiosidade de massa, os direitos individuais homogêneos têm se destacado e sido, majoritariamente, tutelados através das denominas demandas repetitivas. O Judiciário é diariamente sobrecarregado com tais demandas e se revela incapaz de apresentar respostas adequadas a elas, bem como de manter padrões adequados de eficiência. Por sua vez, as ações coletivas têm potencial para lidar com litigiosidade repetitiva, conferindo tratamento justo e eficiente ao tema, mas têm sido relegadas a segundo plano no exercício desta função, preponderando o tratamento individual dos direitos individuais homogêneos. As últimas reformas legislativas no âmbito do direito processual civil investiram em técnicas de reprodução de teses jurídicas para lidar com a litigiosidade de massa. Ocorre que, a uniformização jurisprudencial é pautada em gerenciamento de processos e não possui os mesmos benefícios que o direito coletivo para lidar com tema. Verifica-se que para afirmação do direito coletivo em nosso ordenamento, há óbices normativos, culturais e políticos. Alguns normativos do direito coletivo se relevam retrógrados e dão margem à divergência interpretativa quanto à sua aplicação. A jurisprudência tem exercido papel de complementação das normas de direito coletivo, mas se apresenta como solução instável e insuficiente para dotá-lo de maior segurança jurídica e consequente invocação prática. A representatividade adequada assume papel central para que o processo coletivo seja dotado de maior efetividade, mas há resistência cultural quanto à implementação das alterações necessárias para tanto. A resistência política se materializa no insucesso de inciativas legislativas que endereçaram pontos controversos do direito coletivo. Em suma, faz-se necessária a valorização da tutela coletiva dos direitos individuais homogêneos a partir do rompimento da resistência à implementação de alterações legislativas e elaboração de um projeto legislativo efetivamente adequado ao exercício desse papel, com superação dos óbices culturais, políticos e normativos que opõem para tanto.

In the context of the massification of relationships and the increase of mass litigation, the homogeneous individual rights [individual rights with a common factual origin] have highlighted and have been mostly protected by the repetitive lawsuits. The Judiciary is overloaded with such demands and is unable to provide adequate responses to them, as well as to maintain adequate standards of efficiency. In turn, collective lawsuits have the potential to deal with repetitive litigation, giving a fair and efficient treatment to the issue, but they have been relegated to the background in the exercise of this function, prevailing the individual treatment of homogeneous individual rights. The latest legislative reforms in the scope of civil procedural law in Brazil invested in techniques for reproducing legal theses to deal with the mass litigation. However, the standardization of jurisprudence is based on process management and does not have the same benefits as the collective rights to deal with the issue. It is possible to identify normative, cultural, and political obstacles to affirmation of collective law in Brazilian system. Some norms of collective law are outdated and give rise to interpretive divergence as to their application. The jurisprudence has played the role of complementing the rules of collective law, but it presents itself as an unstable and insufficient solution to provide it with greater legal certainty and consequent application in practice. The adequacy of representation assumes a central role for the collective process to be more effective, but there is a cultural resistance regarding the implementation of the necessary modifications for this purpose. Political resistance materializes in the failure of legislative initiatives that have addressed controversial points of collective law. In short, it is necessary to value collective protection of homogeneous individual rights based on overcoming resistance to the implementation of legislative changes and the elaboration of a legislative project effectively suited to the exercise of this role, overcoming the cultural, political and normative obstacles for that.
