Propõe-se, com essa dissertação, tratar do saneamento e da organização do processo sob a concepção de um processo participativo, atentando-se à influência das partes na formação da convicção do juiz e ao respeito à liberdade que lhes cabe, observados os limites impostos pelo sistema, sem que tal descaracterize a natureza pública que conforma o processo. Para tanto, serão abordados temas atuais do processo civil, como suas crises, seus modelos, o dualismo publicismo e privatismo, o papel do juiz e das partes no processo, as características das atuações desses sujeitos processuais, o princípio dispositivo e a liberdade das partes, isso tudo relacionado de alguma forma ao saneamento e à organização processual. Para melhor compreensão do saneamento e da organização do processo, serão desenvolvidos itens específicos sobre seus aspectos gerais e sobre seus predicados mais relevantes, com a importância que eles têm, as classificações mais comuns e as matérias objeto de enfrentamento. Notar-se-á que o saneamento e a organização processuais estão presentes desde o início e são uma realidade inclusive se processo for julgado sem resolução do mérito ou se houver o julgamento antecipado do mérito, e não apenas quando há necessidade de dilação probatória. Por evidente, será explorado o artigo 357 do Código de Processo Civil, que se propõe a regular mais especificamente o saneamento e a organização do processo, com todas as questões que dele surgem e impactam no desenvolvimento do processo e na postura dos sujeitos processuais para que, ao final, se possa chegar a uma sentença de mérito adequada.

The purpose of this dissertation is to address the pre-trial rulings and organization procedures under the light of a participative procedure, taking into account the influence of the parties in the formation of the judges conviction and the extent of their liberty to influence, considering the limits imposed by the system, avoiding the mischaracterization of the public nature of the procedure. To that end, matters regarding the current purposes of the civil procedure will be addressed, such as its crisis, models, the public vs private dualism, the role of the judge and the parties in the procedures, the characteristics of these subjects performances, the principle of party disposition and the liberty of the parties all of that related, in a manner, to the pretrial rulings and organization decisions of the procedure. For a better comprehension of the pre-trial rulings and organization of the procedure, specific items about its general aspects and its most relevant predicates will be developed, highlighting their importance, their most usual classifications, and the matters worthy of debate. It shall be noticed that the pre-trial rulings and the organization of the procedure are present since the beginning of every procedure, even in cases of summary judgment or dismissal, and not only when there is need for the production of further evidence. Evidently, article 357 of the Brazilian Code of Civil Procedure will be explored, since it regulates specifically the pre-trial rulings and the organization of the procedure, with all the matters that arise from them and their impact on the development of the procedure and performance of the subjects, so that a final merit ruling can be achieved.
