O presente trabalho busca problematizar as interações entre o Judiciário e os órgãos reguladores, sob a ótica da técnica processual de julgamentos de casos repetitivos aplicada em setores regulados da economia. Inserida no contexto da litigiosidade repetitiva no Brasil, a litigiosidade dos setores regulados responde por considerável parte do total de processos repetitivos e possui características que se somam àquelas da litigiosidade repetitiva enquanto gênero, especialmente: (i) a existência de um ente regulador/fiscalizador; (ii) de um aparato administrativo próprio; (iii) de uma profusão de normas regulatórias que se somam às leis; e (iv) a tecnicidade das questões discutidas, que devem ser consideradas quando da definição de teses que serão aplicadas a uma diversidade de processos pela sistemática dos casos repetitivos. Partindo dessas constatações e tendo como pilares básicos a participação e a vinculação, a tese busca analisar se a técnica processual hoje existente está ou não adequada às particularidades dessa litigiosidade própria dos setores regulados, problematizando, ainda, os riscos advindos da aplicação inadvertida da referida técnica. As hipóteses traçadas foram as de que: (i) a técnica processual de julgamento de casos repetitivos não viabiliza a participação efetiva do órgão regulador na formação da tese jurídica; e (ii) essa tese tende a não considerar questões regulatórias. Para verificação das hipóteses propostas, realizou-se, além de pesquisa teórica, um estudo empíricojurisprudencial com os casos repetitivos em matéria regulatória, visando a examinar como se dá a participação do ente regulador na formação da tese jurídica no julgamento de casos repetitivos, e se essa participação se reflete na consideração das razões regulatórias na decisão. Conclui-se que a técnica processual objeto do estudo não é adequada à litigiosidade dos setores regulados, devendo, para tanto, prever a necessária participação do ente regulador na formação da tese jurídica, com poder de influência, como forma de reduzir os riscos de intromissão do Judiciário em questões regulatórias.

The present work has as its objective problematize the interactions between the Judiciary and the regulatory agencies, through the point of view of the procedural technique of the judgement of repetitive cases and their specific prediction regarding the regulated sectors of the economy. Pertaining the context of repetitive litigation in Brazil, the litigiousness of the regulated sectors accounts for a considerable part of the total number of repetitive processes and has characteristics that add to those of repetitive litigation as a gender, especially: (i) the existence of a regulatory/supervisory body; (ii) an administrative apparatus of its own; (iii) a profusion of regulatory norms that are an addition to the laws; and (iv) the technicality of the issues discussed, which should be considered when defining theses that will be applied to a variety of processes by the systematic of the repetitive cases. Based on this observation and having as basic pillars the participation and the binding, the thesis seeks to analyze if the present procedural technique is or is not adequate to the particularities of litigiousness of the regulated sectors, also problematizing the risks that come from the inadvertent application of said technique. The hypotheses drawn were that (i) the effective participation of the regulatory agency is not feasible and (ii) it tends not to consider regulation. In order to verify the proposed hypotheses, an empirical-case study with repetitive cases in regulatory matters was carried out, in addition to theoretical research, aiming to examine how the participation of the regulatory body in the formation of the legal thesis in the judgement of repetitive cases, and whether this participation is reflected in the consideration of the regulatory reasons in the decision. It is concluded that procedural technique that is the object of this study is not adequate to the litigiousness of the regulated sectors, and, it must, if to this end, foresee the necessary participation of the regulatory body in the formation of the legal thesis, with power of influence as a way to reduce the risks of intrusion of the judiciary on regulatory matters.
