Atualmente constata-se a multiplicação de situações de ocupações coletivas de espaços públicos ou privados por grupos com níveis variados de organização, para exercício de direitos fundamentais (como de manifestação e de associação) e direitos sociais (como o de greve e à moradia). Normalmente, a solução desses conflitos são trazidos ao Poder Judiciário por ações possessórias, tal qual pautadas pelo Código de Processo Civil historicamente desenvolvidas para resolução de conflitos intersubjetivos. É evidente o descompasso entre a situação material (coletiva) e a técnica processual utilizada para sua solução (individual), constituindo esse o problema-objeto da presente pesquisa. Objetiva-se demonstrar que há pontos primordialmente comuns entre os conflitos que envolvem as mais diversas formas de ocupação cujo objetivo é o exercício de direitos fundamentais e sociais. Assentada essa premissa, procura-se propor um modelo processual alternativo ao vigente, mediante sugestões de lege lata e de lege ferenda, apto à viabilização da adequada prestação de tutela jurisdicional em conflitos possessórios de natureza coletiva que salvaguarde o direito de participação e de defesa da coletividade de ocupantes. Para demonstrar a gravidade do problema social de que se ocupa a tese, ela se inicia com a análise empírica, qualitativa e descritiva, de casos emblemáticos, de expressão social para constatação do problema-objeto da investigação. Num segundo momento, por meio de revisão bibliográfica correlata, analisa-se o fenômeno possessório por seu viés material, focando, especialmente, o advento de teorias sociais da posse para investigar se ocupações coletivas, legitimadas pelo regular exercício de direitos fundamentais e sociais, configuram exercício de posse funcional, merecedora de proteção jurisdicional. Realiza-se, ainda, o estudo do modelo de tutela jurisdicional possessória instituído pelo Código de Processo Civil de 2015 com vistas a avaliar a (in)suficiência de seus mecanismos à adequada tutela da posse enquanto situação material coletiva, bem como à garantia do direito à participação, ao contraditório e à ampla defesa do grupo de ocupantes. Classificando a posse, fluidamente exercida em ocupações, como interesse coletivo (lato sensu), investiga a existência, no microssistema de tutela coletiva, de técnicas processuais adequadas à sua defesa. Detecta, no entanto, a carência de mecanismos próprios à tutela coletiva da posse socioeconomicamente qualificada exercida por grupos de ocupantes aos quais se nega, por consequência, o direito ao processo. Em vista dessa constatação, propõe, de lege lata e de lege ferenda, técnicas e mecanismos processuais que constituem um modelo de tutela jurisdicional da posse coletiva, calcado: (a) na caracterização dos processos possessórios coletivos como de interesse público; (b) na existência e positivação de ações possessórias coletivas passivas no sistema brasileiro; (c) na necessidade de sumarização das ações possessórias coletivas passivas, franqueado o amplo debate e a efetiva participação do grupo de ocupantes no processo; e (d) na execução negociada como o modelo adequado ao alcance da satisfatividade da tutela jurisdicional possessória coletiva.

Nowadays, there is a multiplication of situations in which groups with different levels of organization collectively occupy public or private spaces for the exercise of fundamental rights (such as demonstration and association) and social rights (such as the right to strike and housing). These disputes are usually brought to the Judiciary for solution by means of possessory actions, provided for in the Brazilian Code of Civil Procedure, which were historically developed to settle intersubjective conflicts. It is clear that there is a mismatch between the material (collective) situation and the procedural technique employed in its solution (individual), and this problem constitutes the object of this research. One intends to demonstrate that there are primarily common points between conflicts involving the most diverse forms of occupations whose purpose is to exercise fundamental and social rights. Once this premise is established, one seeks to propose an alternative procedural model to the one in force through lege lata and lege ferenda suggestions, a model that is capable of providing the adequate judicial relief in possessory conflicts of a collective nature, and safeguards both the right to participation and defense of occupants' collectivity. To demonstrate how serious the social problem of this thesis is, one begins with the empirical, qualitative and descriptive analysis of emblematic cases of social expression, so to verify the problem-object of the investigation. In a second moment, one analyses the possessory phenomenon for its material bias through review of correlative bibliography - focusing especially on the advent of social theories of possession -, in order to investigate if collective occupations, when legitimized by the regular exercise of fundamental and social rights, constitute an exercise of de facto possession that is entitled to court protection. One also studies the model of possessory remedy supported by the Brazilian Code of Civil Procedure of 2015, with the objective to assess the (in)sufficiency of its mechanisms towards not only the adequate protection of possession as a collective material situation, but also the guarantee of occupying groups' rights to participation and to a fair hearing in due adversary proceeding. Fluently exercised in occupations, possession is classified as a collective interest (lato sensu), whereof one investigates - within a micro-system of collective remedies - the existence of procedural techniques that are adequate to its protection. However, one detects the lack of mechanisms proper to the collective protection of a socioeconomically qualified possession exercised by occupying groups, to whom the right to a trial is consequently denied. In view of this finding, one proposes - lege lata and lege ferenda - procedural techniques and mechanisms that constitute a model of protection of the collective possession, based on: (a) characterizing possessory class procedures as public-law processes; (b) the existence of defendant possessory class actions in the Brazilian system and statutory legislation; (c) the need to summarize defendant possessory class actions, enabling a comprehensive debate and effective participation of occupying groups in the process; and (d) soft judicial execution as the adequate model within reach for contentment of collective possessory relief.
