Esta dissertação propõe uma análise e estruturação da garantia do duplo grau de jurisdição a partir dos tratados de proteção dos direitos humanos e de sua interpretação pelos organismos encarregados de monitorá-los, sobretudo, a Convenção Americana sobre Direitos Humanos e a Corte Interamericana de Direitos Humanos. Por meio da análise das normas que compõem os sistemas internacionais de proteção dos direitos europeu, africano, universal e interamericano e das decisões dos órgãos de monitoramento Tribunal Europeu de Direitos Humanos, Tribunal Africano dos Direitos Humanos e dos Povos, Comitê de Direitos Humanos e Corte Interamericana de Direitos Humanos , serão identificados os standards mínimos de conformação da garantia e que devem ser observados internamente pelos Estados. Partindo desse referencial normativo, será efetuada uma análise do ordenamento brasileiro, propondo soluções para sua adaptação pautadas no controle de convencionalidade e na aplicabilidade imediata da garantia.

This study proposes an analysis and the structuring of the double degree of jurisdiction guarantee based on the human rights treaties and its interpretation by the bodies responsible for their monitoring, mainly the American Convention on Human Rights and the Inter-American Court of Human Rights. Through the analysis of the rules that make up the international human rights protection systems european, african, universal and american the minimum standards of conformity of the guarantee that must be observed internally by the States will be identified. On the basis of this regulatory reference, an analysis of the Brazilian legal system will be made, to propose solutions for its adaptation based on the conventionality control and the immediate applicability of the guarantee.
