O presente estudo propõe um exame crítico dos instrumentos processuais de tratamento da litigiosidade repetitiva, sob a perspectiva contemporânea do contraditório, cujo arcabouço garantístico é delineado por sua dimensão dialética e pelos pressupostos fundamentais da comunicação e da participação. O objetivo geral da pesquisa visa a responder à questão componente da hipótese central de trabalho, que consiste na investigação da existência de déficits de contraditório nos instrumentos processuais de tratamento da litigiosidade repetitiva, tanto na estruturação normativa (legal e infralegal) quanto na interpretação dos respectivos institutos, à luz das bases conceituais e epistemológicas apresentadas. Os objetivos específicos visam a elucidar a perspectiva geral da dialética e sua acomodação conceitual no âmbito do direito processual; delimitar as qualidades do contraditório na contemporaneidade sob os marcos da teoria sistêmica luhmanniana e das teorias discursiva e da ação comunicativa habermasianas; situar a atual fase de desenvolvimento do processo civil constitucional brasileiro; analisar criticamente o status quaestionis doutrinário da cooperação processual; sintetizar os aspectos complexos da problemática atinente à litigiosidade repetitiva; e, por fim, confirmada a hipótese geral de trabalho, investigar as implicações do contraditório nos expedientes adotados pelo direito vigente para o tratamento em escala dos conflitos, quanto às técnicas do regime de repercussão geral, da sistemática dos recursos repetitivos e dos incidentes de resolução de demandas repetitivas e de assunção de competência.

This study proposes a critical examination of the procedural instruments for the treatment of repeated litigation, under the contemporary perspective of the contradictory, whose guarantee framework is outlined by its dialectical dimension and by the fundamental assumptions of communication and participation. The general objective of the research is to answer the question that makes up the general working hypothesis. It consists of investigating the existence of deficits of contradictory in the procedural instruments for the treatment of repeated litigation, both in the normative structure (legal and nonlegal) and in the interpretation of the respective institutes, in light of the conceptual and epistemological bases presented. The specific objectives aim to elucidate the general perspective of dialectic and its conceptual accommodation within the scope of procedural law; delimit the qualities of the contradictory in contemporary times in light of the landmarks of Luhmanns systems theory and Habermas communicative and discursive action theory; situate the current phase of development of the Brazilian constitutional civil procedure; critically analyze the doctrinal status quaestionis of procedural cooperation; synthesize the complex aspects of the problem concerning repeated litigation; and, finally, upon confirmation of the general working hypothesis, investigate the implications of the contradictory in the procedures adopted by the current law for the scale treatment of conflicts, regarding the techniques of the general repercussion regime, the repeated appeals system and repeated claim resolution incidents and assumption of jurisdiction.
