Este trabalho tem como objetivo analisar o instituto da arbitragem nacional e suas principais características na tentativa de identificar se sua utilização pode ser feita de forma que litigantes habituais, com mais recursos técnicos e econômicos, obtenham vantagens em detrimento de litigantes ocasionais desprovidos dos mesmos recursos. No primeiro capítulo definiremos o conceito de Fenômeno Repeat Player utilizando como referencial teórico o trabalho de Marc Galanter, Why the Haves Come Out Ahead: speculations on the limits of legal change, publicado em 1974 da revista Law & Society. Serão identificadas as vantagens que são auferidas por litigantes habituais, isto é, Repeat Players, bem como certos elementos que contribuem para que esses litigantes aufiram tais vantagens quando litigam contra litigantes ocasionais, isto é, One-Shotters. No segundo capítulo será feita uma contextualização da utilização da arbitragem na realidade nacional, demonstrando a pertinência da análise proposta. No terceiro capítulo serão abordadas as características processuais da arbitragem no intuito de verificar se contribuem ou não para que o Fenômeno Repeat Player se manifeste. No quarto capítulo serão analisadas as características do instituto da arbitragem sob um viés contratual ou privado, buscando, da mesma forma, identificar se tais características podem favorecer a manifestação do Fenômeno Repeat Player.

This study analyzes domestic arbitration and its features in an attempt to ascertain the possible edge that frequent litigants, usually better armed both from technical and economic standpoints, have over ill-equipped, occasional litigants. The first chapter explores the Repeat Player Phenomenon, taking as theoretical framework Marc Galanter's paper 'Why the "Haves" Come Out Ahead: speculations on the limits of legal change ('Law & Society', 1974), and identifying both the advantages that Repeat Players develop over time and how such advantages manifest or change when facing players that lack them, the so-called One-Shotters. The second chapter contextualizes the use of arbitration in the national scenario, portraying the relevance of the analysis set forth. The third chapter addresses the procedural aspects of arbitration in order to verify whether they promote the Repeat Player Phenomenon or not. The fourth chapter repeats this exercise, however this time placing arbitration under a contractual/private perspective.
