O objetivo da pesquisa desdobrou-se em desvendar a função e a estrutura dos tribunais superiores brasileiros a fim de encontrar eventual problema surgido na origem das cortes e que eventualmente esteja contribuindo para o congestionamento desses tribunais nas últimas décadas, bem como em analisar o juízo de admissibilidade recursal que, afetado pelo congestionamento, foi parcialmente transformado em obstáculo ao volume excessivo de recursos interpostos em nível excepcional. Essas duas temáticas sofreram alterações na reforma do Código de Processo Civil brasileiro, razão pela qual se procurou analisar as mudanças reguladas no novo diploma legal, que voltadas à solução dos problemas que vinham sendo enfrentados no cenário jurídico nacional, em especial os óbices de admissibilidade, possivelmente implicarão aumento no volume de recursos, atuando na contramão de todas as reformas estrangeiras da mesma natureza

The objective of this research was to reveal the role and structure of the Brazilian Superior Court of Justice in order to find the main characteristics that are leading to the accumulation of appeals in court. At the same time, analised the judge acknowledgment in appeals, which was partially turned into an obstacle due to the excessive number of appeals in the extraordinary level. These two topics have gone through changes during a recent legislative renewal, for this reason, choose to analyse the changes ruled in the new procedure code. These changes lead to the obstacle of acknowledgement that will eventually result in an increase in the volume of appeals which goes against all foreign legal reforms of the same nature
