A presente dissertação tem por escopo a análise do incidente de resolução de demandas repetitivas enquanto meio de julgamento de casos repetitivos, restritos às questões de direito, conforme previsto no Código de Processo Civil em vigência, colocando em perspectiva uma análise do instituto à luz da problemática do acesso à justiça e das modificações da sociedade que demandaram a criação de técnicas de julgamento visando a solução dos problemas relacionados à prestação da tutela jurisdicional no âmbito da litigiosidade repetitiva. O trabalho procura apontar alguns aspectos relevantes do incidente de resolução de demandas repetitivas, percorrendo desde a sua contextualização no panorama da litigiosidade repetitiva no país, passando pelos elementos essenciais, práticos e teóricos a respeito do tema, inclusive, natureza jurídica, objeto, requisitos de admissibilidade, aspectos relacionados à tramitação e efeitos da decisão do incidente. Avançou-se acerca de temas polêmicos, posicionando-se a respeito e, inclusive, trazendo os pontos favoráveis e desfavoráveis do instituto.

This dissertation has as its central focus the analysis of the Incidental Motion to Settle Repetitive Litigation as a means of trial of repetitive cases, viewed solely from a legal perspective, as covered by the current Civil Procedure Code, analyzing it in the light of the difficulties regarding access to justice and the changes that have taken place in society that as a consequence requires the creation of judgment techniques that have the objective of solving the problems related to the provision of judicial protection in the sphere of repetitive litigation. This paper seeks to highlight some relevant aspects of the Incidental Motion to Settle Repetitive Litigation, ranging from its contextualization in the scenario of repetitive litigation in the country, going through to the essential, practical and theoretical elements of the subject, including its juridical nature, purpose, requirements for eligibility and aspects related to the procedure and effects. Controversial themes will be covered, with a declared position regarding them, including debating points in favor of and against the mechanism.
