Este trabalho tem como objetivo o estudo do controle judicial no acordo de não persecução penal. Busca, primeiramente, o estudo e o desenvolvimento deste tema, e sugere uma nova terminologia para as formas de resolução do conflito penal, quais sejam, solução conflituosa e solução negociada. A partir disso, passa-se pela análise dos efeitos do intercâmbio de institutos entre os sistemas jurídico anglo-saxônico e romano germânico; para, com isso, buscar identificar as consequências que essas interações ocasionaram nos poderes e papéis atribuídos aos atores jurídicos no âmbito do processo. O estudo aborda, ainda, os poderes reservados aos magistrados dos sistemas jurídicos dos Estados Unidos, França, Portugal, Itália e Alemanha para o exercício do controle judicial em institutos de justiça negociada, em especial naqueles que guardam maior semelhança com o acordo de não persecução penal brasileiro. Estuda-se também, a introdução de mecanismos de justiça negociada no ordenamento jurídico. O trabalho aborda, ainda, a evolução do papel destinado aos juízes no processo penal brasileiro, em especial com a introdução do juiz das garantias em nosso ordenamento jurídico. Por fim, o estudo aborda especificamente os alcances e limites do controle judicial sobre a regularidade, legalidade e voluntariedade no âmbito do acordo de não persecução penal.

This work aims to study judicial control in the non-criminal prosecution agreement. It seeks, to start, the study of the development and a new terminology is suggested for the forms of resolution of the criminal conflict, namely, confrontational solution and negotiated solution. From this, the analysis of the effects of the exchange of institutes between the Anglo-Saxon and Roman-Germanic legal systems is analyzed in order to, therefore, identify the consequences that these interactions had on the powers and roles assigned to legal actors within the scope of the process. The study also addresses the powers reserved for magistrates of the legal systems of the United States, France, Portugal, Italy, and Germany to exercise judicial control in institutes of negotiated justice, especially in those that bear the greatest similarity to the Brazilian non-criminal prosecution agreement. The introduction of mechanisms of negotiated justice in the legal system is also studied. The work also addresses the evolution of the role assigned to judges in the Brazilian criminal procedure, especially with the introduction of the guarantee judge in our legal system. Finally, the study specifically addresses the scope and limits of judicial control over regularity, legality, and willingness within the scope of the non-criminal prosecution agreement.
