A entrada em vigor do Código de Processo Civil, em 18 de março de 2016, tornou necessário revisitar os limites objetivos da apelação. Correspondem às pretensões, pontos, questões e provas que podem ser objeto de cognição pelo órgão recursal, por ocasião da interposição do recurso. Assim, na presente dissertação, examinase a profundidade e a extensão da devolução, assim como a disciplina da superveniência. Objetiva-se, pois, fixar a medida que as pretensões deduzidas pelas partes comportam novo julgamento e eventualmente decisão direta pelo órgão ad quem; estabelecer quais elementos produzidos frente ao órgão a quo devem ser considerados; investigar a devolução das questões decididas antes da sentença; e enfrentar a possibilidade de admissão de novas alegações e a produção de novas provas. No que toca à extensão da devolução, analisa-se a limitação da cognição aos capítulos impugnados; a aplicação da teoria da causa madura e a correção de nulidades em segundo grau de jurisdição. Segue-se com o estudo da profundidade da devolução, com o tratamento do que se deve conceber como matéria impugnada, questões suscitadas e discutidas no processo, fundamentos do pedido ou da defesa não apreciados em primeiro grau de jurisdição, matérias cognoscíveis de ofício e questões anteriores à sentença, decididas ou não. Cuida-se, ainda, da reformatio in peius, que limita, bem como dos honorários de sucumbência e da aplicação de sanções processuais, que ampliam a cognição em grau de recurso. Finaliza-se com o debate acerca da possibilidade de arguição de fato novo, fato superveniente e direito superveniente. Com efeito, conclui-se que pretensões, pontos, questões e provas que não foram objeto de apreciação em primeiro grau de jurisdição podem ser conhecidas quando do julgamento da apelação, nas hipóteses expressamente admitidas pelo legislador. Quebra-se, portanto, o dogma da supressão de instância, com o reconhecimento de que o duplo grau de jurisdição não se impõe, por si só, constituindo-se como mero corolário do devido processo legal.

The Civil Procedure Code, which became effective on 18 March, 2016, requires that the objective limits of the appeal are reconsidered. Such limits are the claims, arguments, issues, and evidence that may be reviewed by the appelate court when the appeal is presented. Therefore, this work discusses the depth and breadth of the review, as well as the discipline of supervenience. The objective, then, is to determine how the claims presented by the parties may be subject to a new trial and eventually to an initial decision by the appelate court; to determine which defenses offered before the lower court should be considered; to study the review of matters decided prior to sentencing; and to address the possibility that new arguments and new evidence may be admissible. With regard to the breadth of review, this work analyzes the limitation of review to challenged sections; the application of the mature cause theory ("teoria da causa madura") and the correction of voidabilities at the appelate level. Then it explores the depth of review, the question of what should constitute challenged matter, issues raised and discussed in the proceeding, arguments in support of a claim or of a defense not analyzed by the court of first instance, matters subject to ex officio review and issues that precede sentencing, settled or not. It also addresses reformatio in pejus, which limits, and the burden of defeat fees and procedural sanctions, which expand the scope of review on an appelate level. It concludes with the debate about the admissibility of new facts, supervening facts and supervening rights. Indeed, it concludes that claims, arguments, issues, and evidence that have not been reviewed by the court of first instance may be admitted by the appelate court when expressly allowed by lawmakers. Hence, the dogma of supression of instance is broken by recognizing that the right of appeal is not self-imposed, but a simples corollary of due process of law.
