Inicialmente foi feito breve apanhado da liberdade e sua mitigação pela prisão, ressaltando-se, então, os sistemas de avaliação de prova e sua relevância no tema. A seguir, foi feito esboço histórico da custódia cautelar no direito comparado, em especial em Portugal e Itália, que serviram de inspiração para nosso novo modelo cautelar. O processo penal, em si, foi analisado em sua técnica da cautelaridade e sob o prisma do devido processo legal. A nova sistemática da custódia cautelar, introduzida pela Lei 12.403/2011, foi analisada à luz da proporcionalidade e da presunção de inocência, a buscar um equacionamento entre os direitos e garantias fundamentais e a eficácia estatal na solução dos conflitos, contrapondo a liberdade individual e a segurança social. Enfim, o foco principal deste estudo científico foi demonstrar a importância do novo sistema de medidas cautelares pessoais, rompendo a bipolaridade prisão/liberdade, denotando o caráter excepcional da custódia provisória, fato corroborado pela criação na novel legislação de medidas alternativas adequadas à natureza do crime e à situação do criminoso.

Initially a brief survey of freedom and its mitigation by prison was made, emphasizing, then, the systems of evaluation of evidence and its relevance in the subject. The following was a historical sketch of precautionary custody in comparative law, especially Portugal and Italy, which served as inspiration for our new precautionary model. The criminal procedure itself was analyzed in its precautionary technique and under the prism of the principle of due process. The new system of pre-trial detention, introduced by Law 12.403/2011, was interpreted in the light of proportionality and presumption of innocence, to seek an equation between fundamental rights and guarantees ad state effectiveness in the resolution of conflicts, as opposed to individual freedom and social security. Finally, the main focus of this scientific study was to demonstrate the importance of new system of personal precautionary measures, breaking the bipolar prison/freedom, denoting the exceptional character of the provisional custody, a fact corroborate by the creation in the novel legislation of alternative measures appropriate to the nature of the crime and the situation of the criminal.
