As leis relacionadas à disciplina, material e processual, dos interesses coletivos formam um microssistema, cuja efetiva tutela depende do devido redimensionamento de institutos, princípios e regras do processo civil clássico, destinado à disciplina de litígios intersubjetivos, discutindo interesses meramente individuais. Apesar da estrutura substancial diferenciada dos interesses difusos e coletivos, continua-se a aplicar, recorrentemente, a mesma lógica e as mesmas regras do processo individual aos processos coletivos, sem qualquer diferenciação, o que prejudica a tutela daqueles interesses, pertencentes a todos ou a uma parcela significativa da sociedade. No atual cenário legislativo, a técnica da flexibilização do procedimento parece ser essencial à tutela efetiva dos interesses coletivizados, em busca da concretização da garantia do acesso à ordem jurídica justa, efetiva e em tempo razoável, abandonando-se a observância estrita do procedimento comum previsto na legislação individual (CPC), quando as peculiaridades do litígio ou do interesse em discussão exigirem, observados certos critérios. Apesar do insucesso das tentativas legislativas de reforma e aprimoramento do microssistema do processo coletivo, parece que as inovações introduzidas no sistema processual brasileiro, notadamente pelo advento Código de Processo Civil de 2015, reforçaram os fundamentos dogmáticos sobre o princípio da adaptabilidade procedimental, que autoriza a alteração do procedimento pelos sujeitos processuais (juiz e partes), desde que observados determinados parâmetros, atenuando, pois, o rigor dos princípios da legalidade das formas e da rigidez procedimental tradicionalmente inseridos em nosso sistema. A utilização da técnica da flexibilização procedimental parece, pois, essencial à dinâmica dos processos coletivos, de acordo com as hipóteses cogitadas no trabalho.

Laws related to the discipline, material and procedural, of collective interests form a microsystem, whose effective protection depends on the proper resizing of the institutes, principles and rules of the classical civil process, aimed at the discipline of intersubjective disputes, discussing merely individual interests. Despite the differentiated structure of diffuse and collective interests, the same logic and rules of the individual process continue to apply recurrently to collective processes without any differentiation, which undermines the protection of those interests, belonging to all or one significant portion of society. In the current legislative scenario, the technique of easing the procedure seems to be essential to the effective protection of the collectivized interests, seeking to ensure the guarantee of access to the fair, effective and reasonable time, abandoning the strict observance of the common procedure provided for. individual legislation (CPC), when the peculiarities of the dispute or interest under discussion require. Despite the failure of legislative attempts to reform and improve the collective process microsystem, it appears that the innovations introduced in the Brazilian procedural system, notably the advent of the Civil Procedure Code of 2015, reinforced the dogmatic foundations on the principle of procedural adaptability, which allows alteration of the procedure by the procedural subjects (judge and parties), provided that certain parameters are observed, thus attenuating the rigor of the legality of the procedural form and rigidity traditionally provided for in our system. The use of the procedural flexibilization technique seems, therefore, essential to the dynamics of the collective processes, according to the hypotheses considered at work.
