Diante da alteração paradigmática sofrida no direito brasileiro com o advento do atual Código de Processo Civil, inaugurou-se o modelo cooperativo de processo civil e diversas consequências foram pretendidas pelo legislador. Discutiu-se a inclusão de normas fundamentais na legislação infraconstitucional, a descentralização dos poderes do juiz, a inclusão de deveres para todos os sujeitos processuais e a nova dinâmica do princípio do contraditório. A primazia do julgamento de mérito e as disposições legais que demandam a superação de vícios formais conferem a feição do modelo processual analisado. O desenvolvimento dialético do processo e a implementação dos deveres de cooperação visam conferir efetividade ao provimento jurisdicional expedido, sendo a materialização do direito o fim visado por todos.

As a result of the paradigmatic legislative changes experienced in Brazil in light of the enactment of the Code of Civil Procedure currently in force, it has been introduced the cooperative model of civil procedure and several consequences were intended by the lawmaking body. The paper dealt with the inclusion of fundamental rules in the infra constitutional status, the decentralization of the Courts' powers, the inclusion of duties for all the parties to the dispute and the new framework of the principle of adversarial proceedings. The judgment upon the merits and the statutory provisions that favour the overturn of procedural defects features the procedural model analyzed. The dialectical development of the procedure and the implementation of the duties of cooperation aim at ensuring the effectiveness of the decision issue by the Courts, which is the enforcement of the law pursued by all.
