Abstract in English
This work adresses the admissibility requirements of appeals in the 2015 Civil Procedure Code system, focused on interest in appealing. It starts from the distinction between admissibility and merits, and stresses the importance of the first for the fundamental values of effectiveness and legal certainty. It draws a parallel between the prerequisites of the judgment of the merit in the first degree - procedural prerequisites and conditions for law suit - and the admissibility requirements of appeals, and proposes a classification for the latter. It examines the possibility to cure the defects in admissibility and the subjection of the admissibility requirements to procedural agreements by the parties. Then, it deepens the study of the interest in appealing, placing it in the system based on the utilitarian idea of interest to the Law and the Process. It examines the interest in appealing through its elements, namely, necessity and utility. The latter is studied from the perspective of each of the legitimated to appeal and the peculiar questions they raise, questioning the sufficiency of the criterion of succumbence, aiming to give it a proper meaning. Finally, it analyzes the interest in appealing in its relation to the protection of the legal system itself, especially in the search for the improvement of the judicial provision and the integration to a system of binding pronouncements.
