Atentos aos problemas atinentes à litigância repetitiva, notadamente o risco de ofensa à isonomia e à segurança jurídica e o assoberbamento do Poder Judiciário provocado por este tipo de litigância, os legisladores do Código de Processo Civil criaram, com inspiração no ordenamento jurídico alemão, o Incidente de Resolução de Demandas Repetitivas. O mencionado incidente é, sem dúvida, uma grande novidade do diploma legal, razão pela qual, diante da alta expectativa depositada no mais novo instrumento processual, o presente trabalho busca analisar o impacto do julgamento do Incidente de Resolução de Demandas Repetitivas no Tribunal de Justiça de São Paulo. Para tanto, opta-se por avaliar o impacto relativamente a um tema de Incidente de Resolução de Demandas Repetitivas, já julgado pelo Tribunal de Justiça de São Paulo, escolhendo-se o Tema nº 05, que trata da possibilidade de absorção do valor integral do Adicional de Local de Exercício ao salário-base do policial militar.

Aware of the problems due to repetitive litigation, particularly the risk of offense to isonomy and legal certainty and the superabundance of the Judiciary caused by this type of litigation, the legislators of the Civil Procedure Code, inspired by the German legal system, created the incidental motion to settle repetitive claims. This incidental motion is, unquestionably, a great novelty outlined at the Civil Procedure Code, which is why, given the high expectation created by the new Civil Procedure Code, this dissertation aims to analyse the impact of the judgment of the incidental motion to settle repetitive claims on São Paulo Court of Law. Hence, this dissertation opts for assess the impact of one theme of incidental motion to settle repetitive claims, already judged by São Paulo Court of Law, choosing the Theme n. 05, which is about the possibility of the addition of the whole ammount of Adicional de Local de Exercício to the basic wage of the policeman.
