Neste trabalho, procurou-se esmiuçar os contornos do precedente judicial no processo penal brasileiro e identificar qual o discrímen adequado a diferenciar sua força vinculante, defendendo-se seja a abreviação da via recursal ordinária. No primeiro capítulo foram estudados elementos básicos de teoria geral dos precedentes judiciais (conceito, distinção com institutos assemelhados, elementos, classificação, fundamentos, destinatários e efeitos, entre outros), classificando-os quanto à eficácia em persuasivos, vinculantes (ou normativos) e quase vinculantes. Para garantia da autoridade dos vinculantes é disciplinada em nosso ordenamento a reclamação; dos quase vinculantes, especialmente o julgamento monocrático pelo relator. A desobediência aos meramente persuasivos não enseja a abreviação da via recursal ordinária, carecendo esses precedentes, portanto, de obrigatoriedade. No segundo capítulo, foram estudadas as técnicas de aplicação e superação dos precedentes judiciais obrigatórios, notadamente distinção (distinguishing), sinalização (signaling) e superação (overruling). No terceiro, foi feito panorama dos precedentes judiciais nos sistemas jurídicos contemporâneos ocidentais (common law Inglaterra e EE.UU.AA; civil law Itália, Alemanha, França e Espanha), bem assim averiguadas convergências entre esses sistemas no tocante ao tema. No último capítulo, foi feito estudo dos precedentes no direito nacional, com breve histórico até o Código de Processo Civil atual e na sequência pesquisa do sistema de precedentes instituído pelo CPC/2015. Perscrutou-se a aplicabilidade desse sistema ao processo penal e quais são os precedentes vinculantes, quase vinculantes e meramente persuasivos nesta seara. Finalmente, realizou-se análise crítica do tema no Projeto de Lei do Novo Código de Processo Penal (PLS 156/2009 e PL 8.045/2010), com proposta de alteração.

This paper aims the judicial precedent in Brazilian criminal procedure, especially identifying the appropriate discrimination to differentiate its binding force, defending it is the abbreviation of the ordinary appeals route. In the first chapter, basic elements of the general theory of judicial precedents were studied (concept, distinction with similar institutes, elements, classification, grounds, addressees and effects, among others), classifying them in terms of effectiveness in persuasive, binding (or normative) and almost binding. In order to guarantee the authority of the binding ones, the claim (reclamation) is disciplined in our legal system. Disobedience to the quasi-binding ones gives rise to a monocratic judgment. Discrepancy to the merely persuasive does not give rise to the abbreviation of the ordinary appeal route, lacking these precedents, therefore, of mandatory. In the second chapter, the techniques for applying and departing from precedents were studied, notably distinguishing, signaling and overruling. In the third, an overview of judicial precedents in contemporary western legal systems (common law England and USA; civil law Italy, Germany, France and Spain) was made, as well as convergences between the systems regarding the subject. In the last chapter, a study of the subject in national law was made, with a brief history until the current Civil Procedure Code and research of the precedent system established by CPC/2015. The applicability of this system to criminal proceedings was investigated and which are the binding, quasi-binding and merely persuasive precedents in this field. Finally, a critical analysis of the theme was carried out in the Draft Law of the New Code of Criminal Procedure (PLS 156/2009 and PL 8.045/2010), with a proposal for an amendment.
