Este trabalho consiste em uma investigação de natureza dogmática sobre a motivação das decisões judiciais no processo civil brasileiro contemporâneo, voltada ao conteúdo normativo do artigo 489, § 1º, do Código de Processo Civil de 2015, a fim de fornecer um enquadramento conceitual apropriado para a discussão atinente ao objeto da motivação das decisões judiciais e, em especial, refutar a tese segundo a qual o juiz está obrigado a enfrentar todos os argumentos deduzidos pelas partes no processo, conforme inciso IV daquele artigo.

This research consists of a dogmatic investigation on the motivation of judicial decisions in the contemporary Brazilian procedural law, focused on the normative content of article 489, § 1º, of the Brazilian Code of Civil Procedure of 2015, in order to provide an appropriate conceptual framework for the discussion regarding the object of the motivation of judicial decisions and, notably, to refute the thesis according to which the judge is obliged to face all the arguments deduced by the parties in process, according to item IV of that article.
