O presente trabalho tem por objetivo central discutir as diferenças experimentadas pelos litigantes ocasionais, em juízo, no contexto de demandas repetitivas. Valendo-se de da classificação de Marc Galanter, que divide os litigantes em habituais (repeat players) e eventuais (one-shotter), de acordo com a frequência com que litigam, bem como a partir do marco teórico de Rebecca L. Sandefur a respeito das questões de gênero, cor e classe social, o estudo consistiu na verificação de como as diferenças de classe social (vulnerabilidade econômica) repercutem nas experiências dos litigantes eventuais em processos repetitivos. Para tanto, buscou-se referencial teórico a respeito da litigância repetitiva, suas possíveis causas e principais instrumentos processuais, cotejando-os com noções de acesso à justiça. Como segunda etapa, reuniu-se repertório sobre condições de vulnerabilidade, conceito e suas espécies, em especial a questão da vulnerabilidade econômica, assumida como sinônimo de hipossuficiência neste trabalho. Na terceira etapa, a fim de verificar a existência e em que consistem tais diferenças, a pesquisa empírica, por meio de estudo de caso, buscou confrontar as trajetórias dos conflitos de dois recursos repetitivos afetados junto ao Superior Tribunal de Justiça. Ambos os casos selecionados abordavam o mesmo assunto: a validade da cobrança de corretagem nos contratos de compra e venda de imóveis na planta, fator que contribuiu para o adequado confronto das experiências tidas em juízo pelos litigantes eventuais em face do litigante habitual. A pesquisa contou também com entrevistas com atores dos casos repetitivos que tramitaram pelo STJ.

This paper aims to discuss the differences experienced by occasional litigants in court in the context of repetitive demands. Using the classification of Marc Galanter, which divides the litigants into repeat players and occasional one-shotter according to the frequency with which they litigate, as well as from Rebecca L. Sandefur's theoretical framework, regarding gender, color and social class, the study consisted in verifying how social class differences (economic vulnerability) affect the experiences of eventual litigants in repetitive processes. Therefore, was developed the theoretical framework about repetitive litigation, it´s possible causes and main procedural instruments, comparing them with notions of access to justice. As a second stage, a repertoire was gathered about conditions of vulnerability, concept and it´s species, especially the issue of economic vulnerability, assumed as a synonym of hyposufficiency in this work. In the third stage, in order to verify the existence and what these differences consist of, the proposal of empirical research, through case study, sought to confront the trajectories of the conflicts of two repetitive resources affected by the Superior Court of Justice. Both selected cases addressed the same subject: the validity of the brokerage charge in the real estate purchase and sale contracts at the plant, a factor that contributed to the adequate confrontation of the experiences held by the eventual litigants against the repetitive litigant. The research also included interviews with some actors of the repetitive cases that were processed by the STJ.
