O presente estudo examinou o exercício da atividade jurisdicional no âmbito do sistema de precedentes judiciais obrigatórios estruturado pelo Código de Processo Civil. Embora tal sistema tenha traços inovadores, nada mais é do que o aperfeiçoamento evolutivo de uma necessidade, já verificada na tradição jurídica brasileira, de fortalecimento da eficácia dos precedentes e uniformização jurisprudencial. A introdução de um sistema de precedentes obrigatórios, contudo, tem o condão de promover grandes alterações de paradigma na cultura jurídica brasileira. E uma destas alterações de paradigma está diretamente relacionada à forma de exercício da atividade jurisdicional no âmbito do sistema de precedentes judiciais obrigatórios. Afinal, a norma formada por um precedente judicial obrigatório não mais ficará restrita aos limites do caso em julgamento. Diferentemente, ela servirá como paradigma e estenderá seus efeitos vinculativamente para todos os casos análogos futuros. À luz deste panorama, por meio da revisão bibliográfica acerca da referida temática, buscou-se examinar o exercício da atividade jurisdicional neste contexto.

This study has examined the exercise of jurisdictional activity within the system of binding precedents structured by the Code of Civil Procedure. Although such system has innovations, it is nothing more than the improvement of a need, already verified in the Brazilian legal tradition, of strengthening the effectiveness of precedents and jurisprudential standardization. The introduction of a system of binding precedents, however, has the potential to promote a major change of model in Brazilian legal culture. In the case of jurisdictional activity, subject of this research, a resizing is imposed in the way it is exercised. This is justified because the rule formed by a binding precedent will no longer be restricted to the limits of the case at trial. Differently, it will serve as a paradigm and will extend its effects, binding to all future similar cases. In this context, through the bibliographical review of the aforementioned theme, this study tried to exam the exercise of the jurisdictional activity in this context.
