O presente trabalho buscou analisar os aspectos relevantes referentes à investigação criminal realizada diretamente pelo Ministério Público. Assim, através do método dialético, examinou-se, primeiramente, a possibilidade de se ter tal investigação, analisando os argumentos contrários e favoráveis veiculados na doutrina e na jurisprudência, em especial no Recurso Extraordinário n.º 593.727/MG, e concluindo-se pela possibilidade da investigação criminal direta. A seguir, foram analisados os dispositivos constitucionais, da normativa internacional, legais e infralegais pertinentes, a fim de verificar como se regulamenta a investigação criminal do Ministério Público em nosso ordenamento. Por fim, foram analisadas questões relevantes envolvendo esta investigação criminal, sob o prisma da dicotomia eficiência e garantismo, constatando-se que o procedimento investigatório criminal não viola o devido processo legal, que o contraditório e a ampla defesa merecem ser observados na fase investigatória preliminar, tanto quanto possível, que o procedimento investigatório criminal do Ministério Público tem, como regra, a publicidade, o que permite um maior controle sobre as atividades, mas não deve se confundir com a exposição indevida do investigado, e que é necessário compatibilizar a investigação criminal do Ministério Público com aquela desenvolvida pela polícia, a fim de se ter uma maior eficiência na atuação das duas instituições.

The following paper has tried to examine the relevant aspects of the criminal investigation that is directly promoted by the Prosecutors. Through the dialectical method, it has been examined, at first, the possibility of having this kind of investigation, with the analysis of the main arguments in favor and contrary presented by authors and Ministers of the Supreme Court, in the case RE n.º 593.727/MG, reaching the conclusion that the existence of this investigation is possible. Afterwards, the constitutional, international and internal laws and infralegal regulations have been examined, to understand how the theme is regulated. In the end, some important questions involving the efficiency and the rights of the citizen in the investigation have been examined, noticing that the procedure does not violate the due process of law, that the contradictory and the right of defense need to be observed in this moment, as much as possible, that the procedure is public, which allows a greater control over the activities, but this does not allow the exposure of the investigated person, and that it is necessary to make the investigations lead by the Prosecutors and lead by the police compatible, in order to obtain a greater efficiency on both cases.
