O presente trabalho tem como propósito a análise da figura do amicus curiae no direito processual civil brasileiro, especialmente após a edição da Lei 13.105/2015. Com a fixação do que entendemos ser a natureza jurídica do amigo da corte, tratou-se dos seguintes itens: (a) do tipo de interesse processual que permite a sua atuação no processo; (b) das hipóteses de intervenção; (c) do modo pelo qual se dará sua intervenção, considerando se se trata de poder discricionário do juiz sua admissibilidade; (d) dos poderes que pode exercer no processo; (e) das questões que pode aduzir no processo, se de fato e de direito; (f) da necessidade ou não de capacidade postulatória; (g) da possiblidade de sua condenação nas verbas sucumbenciais; (h) da sua legitimidade recursal; (i) da "eficácia de sua intervenção", isto é, uma vez determinada qual a relação do amicus curiae com o objeto do processo, é importante destacar se ficará ele vinculado à "justiça da decisão", à coisa julgada, ou se simplesmente não fica vinculado a nada.

The analysis presented in this essay suggests that amici curiae is about to play an important role in brazilian litigation. Though unchecked, the impacts of the friend of the court in the decisionmaking process must be openly acknowledged in Brazil, especially because courts freely admit virtually every amicus brief offered. Since there are no relevant statistic studies concerning amicus curiae in Brazil, the influences of the friend of the court is about to becomes a remarkable phenomenon once only recently it was systematic introduced in this country by the new procedural legislation. Given the increasing workload of the Brazilian courts and their willingness to grand these motions, we present what might be the procedure of the amicus curiae briefs in the face of the new legislation in witch the friend of the court is openly recognized as a third party intervener.
