A presente dissertação versa sobre o princípio nemo tenetur se detegere, que compreende o direito à não autoincriminação e sua relação com as intervenções corporais coercitivas. O objetivo geral traçado é analisar se esse direito contra a autoincriminação se estende (ou não) às intervenções corporais coercitivas, ou seja, examinar se, à luz do direito de não produzir provas contra si mesmo, tais meios de obtenção de prova do corpo do investigado/acusado podem (ou não) ser realizados mesmo contra a sua vontade. Para esse mister, o estudo tem como suporte metodológico a abordagem dedutiva e a técnica de pesquisa bibliográfica. Estruturalmente, divide-se em capítulos, onde se apresentam as análises e o referencial teórico de base. O primeiro capítulo se dedica a abordagens relativas à evolução histórica, ao conteúdo e a eventuais limites do princípio nemo tenetur se detegere. O segundo analisa julgados da Corte Europeia de Direitos Humanos - uma vez que a Corte Interamericana de Direitos Humanos não apresenta julgados sobre o tema - a fim de verificar se a Corte vem autorizando a execução de intervenções corporais coercitivas mesmo diante do direito à não autoincriminação e, em caso positivo, conhecer quais os parâmetros utilizados para tanto. Neste ponto do estudo, demonstra-se que a posição da Corte é seguida por diversos países não só do continente europeu, mas também do continente americano. O terceiro capítulo aborda o tema no âmbito da realidade brasileira e o intuito é compreender como a legislação, a doutrina e a jurisprudência nacionais vêm tratando o assunto. Findo o esforço de pesquisa, a conclusão a que se chega, com o auxílio do método comparativo, é que, apesar de haver uma tendência internacional de flexibilização do princípio nemo tenetur se detegere, no que tange a autorizar a realização de intervenções corporais coercitivas, de acordo com os parâmetros estabelecidos pela Corte Europeia de Direitos Humanos, esta não é a realidade brasileira, pois, aqui, a medida investigativa não é diretamente regulamentada nem adotada, não havendo perspectiva de que isso venha a ocorrer em breve. Não obstante, caso isso ocorra futuramente, os parâmetros definidos devem ser aqueles da Corte Europeia de Direitos Humanos.

The present dissertation is about the principal nemo tenetur se detegere which consists of the right to non self-incrimination and its relation to coercive body interventions. The general objective traced is to analyze whether this right to non self-incrimination extends itself (or not) to the coercive body interventions, i.e., examine if, under the light of the right not to produce evidences against oneself, the aforementioned measures to obtain body proof of the investigated/accused may (or not) be realized even against his/her will. By considering this situation, the study has as methodological support a deductive approach, the technique of bibliographical research and, structurally, divided into chapters where analysis can be found as well as the basic theoretical reference. The first is dedicated to the historical evolution of relative approaches, the content and eventual limits of the principle nemo tenetur se detegere. The second chapter analyzes cases already judged by the European Court of Human Rights - whereas the Interamerican Court of Human Rights has no previous cases judged regarding this topic - in order to verify whether the Court is actually authorizing the execution of coercive body interventions despite the right of non self-incrimination and, if so, become fully aware of the parameters used for such purposes. Further on, there will be a demonstration regarding the position of the Court which is followed by many European countries, and American ones as well. The third chapter comprises the main topic within the scope of Brazilian reality and the objective is to understand how the national legislation, doctrine and jurisprudence are dealing with this matter. Finally, to complete the thesis, with the help of the comparative method and based on what was discussed in the previous chapters, one can demonstrate that, besides there being an international tendency to flexibilize the principle nemo tenetur se detegere to authorize performing coercive body interventions, according to the parameters established by the European Court of Human Rights, this is not the reality of Brazil, because here these coercive investigative measures are not regulated or authorized nor is there any perspective that it may occur soon. However, if this does occur in some moment in the future, the parameters brought by the European Court of Human Rights will be adopted in these cases.
