A tese é desenvolvida com o propósito de questionar o regramento das cautelares patrimoniais do Código de Processo Penal. Inicia-se com a análise da teoria de Piero Calamandrei e na sequência são apresentadas críticas e sugestões. O método empregado consiste sobretudo na análise da literatura sobre o tema, com especial ênfase às de origem brasileira e italiana. A doutrina criada em outros países, como Argentina, Espanha, França e Portugal, é também foco de consulta. Defendida a ideia de que existe o direito material de segurança e que compete ao legislador a criação regras de caráter adjetivo com o propósito de assegurá-lo, são analisados os dispositivos do citado diploma legal e do Projeto de Código de Processo Penal, em trâmite no Congresso Nacional. Constata-se que ambos não atendem tal propósito. Propõe-se, então, a criação de novo modelo, em harmonia com aquele presente no Código de Processo Civil, em razão da natureza extrapenal das medidas. Conclui-se que previsão de cautelar inominada permite que de forma mais prática e eficaz se alcance o objetivo de assegurar o direito que se mostra provável.

Abstract in English
The thesis is developed with the purpose of questioning the regulation of the patrimonial precautions of the Code of Criminal Procedure. It begins with an analysis of Piero Calamandrei's theory, followed by criticisms and suggestions. The method employed mainly consists of analyzing the literature on the subject, with special emphasis on those of Brazilian and Italian origin. The doctrine created in other countries, such as Argentina, Spain, France and Portugal, is also the focus of consultation. Having defended the idea that there is a material right to security and that it is up to the legislator to create rules of an adjective nature with the purpose of ensuring it, the provisions of the aforementioned legal diploma and the Draft Code of Criminal Procedure, in progress in the National Congress. It appears that both do not meet this purpose. It is proposed, then, the creation of a new model, in harmony with the one present in the Code of Civil Procedure, due to the extra-criminal nature of the measures. It is concluded that the provision of an unnamed precautionary measure allows a more practical and effective way to achieve the objective of assuring the right that proves to be probable
