A presente pesquisa tem por enfoque a ofensa reflexa, termo jurisprudencial desenvolvido no seio do Supremo Tribunal Federal como forma de restringir o fluxo de recursos extraordinários, e suas consequências para a proteção dos princípios constitucionais do processo. O recurso extraordinário foi o instrumento de controle de constitucionalidade pioneiramente introduzido em nosso ordenamento, com o objetivo levar à apreciação da mais alta Corte do País atos inconstitucionais alegadamente praticados em casos concretos. Seu papel foi se alterando ao longo do tempo, especialmente diante da crise institucional do Supremo Tribunal Federal. A crise possui causas estruturais, incluindo a cumulação de diversas funções constitucionalmente atribuídas à Corte Suprema e a própria natureza analítica e detalhada de nossa Constituição. Para superar a crise, o Supremo Tribunal Federal passou a criar obstáculos ilegítimos ao recebimento dos recursos extraordinários, que preponderam nas estatísticas, a fim de estancar o fluxo numérico. Dentre eles, ganha destaque a ofensa reflexa, que impede a apreciação de alegações de inconstitucionalidade quando o debate pressuponha a interpretação de texto infraconstitucional. Esta corrente jurisprudencial impacta fortemente na proteção dos princípios-garantia constitucionais do processo, porque além de previstos constitucionalmente, são detalhados pela legislação infraconstitucional, o que motiva a inadmissibilidade de inúmeros recursos extraordinários lastreados nestes princípios. A solução não encontra amparo no ordenamento porque, além de serem alçadas à condição de direitos fundamentais pela Constituição Federal, as garantias processuais possuem um núcleo mínimo, cujo conteúdo deve ser fixado pelo Supremo Tribunal Federal, a fim de evitar decisões teratológicas

This research focus on the "reflex offense", jurisprudential expression developed by the Brazilian Supreme Court ("Supremo Tribunal Federal") as a way to restrict the flow of extraordinary appeals ("recursos extraordinários"), and its consequences to the protection of the constitutional principles of process. The extraordinary appeal was the first legal instrument of constitutional control of the Brazilian legal system, created with the objective of submitting to the highest Court of the country unconstitutional acts allegedly practiced in concrete cases. Its role, however, was altered over time, especially because of the institution "general repercussion" (repercussão geral), and regarding the institutional crisis by which the Supreme Court is passing through since its creation, accentuated in the first half of the 20th century. This crisis has essentially structural causes, including the accumulation of diverse functions constitutionally attributed to the Supreme Court and the analytic and detailed nature of the Brazilian Constitution. Aiming the overcome of the crisis, many legislative and jurisprudential solutions were created, with no success. The Supreme Court, so, started to create illegitimate obstacles to contain the flow of extraordinary appeals, which have a prominent position in the Tribunal statistics. Among them, outstands the "reflex offense", which prevents the analysis of alleged unconstitutional acts, when the debate presupposes the interpretation of legal rules. This piece of jurisprudence produces great impact in process guarantees' protection, as they are not only constitutionally established, but also detailed in legal level. This jurisprudential solution does not have legal fundament because, besides the fact that those guarantees are constitutionally classified as fundamental rights, they have a minimum content, that should be defined by the Supreme Court, in order to prevent teratological decisions
