Essa dissertação visa a desenvolver o tema da desconsideração da personalidade jurídica, com enfoque em sua influência diante dos diversos institutos processuais. Vive-se um momento de necessidade de nova delimitação dos aspectos processuais da desconsideração de personalidade jurídica. Isso porque, diferentemente do Código de Processo Civil de 1973, o Código de Processo Civil de 2015 (L. 13.105/2015) inovou ao prever o "incidente de desconsideração da personalidade jurídica", instituto destinado a regulamentar processualmente a desconsideração episódica da personalidade jurídica. A opção do legislador em instituir um específico procedimento revela nítida preocupação em se observarem os princípios do contraditório e da ampla defesa ao citado no incidente, além de, em última análise, caminhar ao encontro dos reclamos de eficiência e economia processuais. Assim, analisar-se-á as alterações empreendidas pelo novo diploma processual brasileiro, sem olvidar para as discussões doutrinárias travadas sob a égide do Código revogado. Apenas mediante análise dessas discussões será possível analisar se o Código, de fato, atendeu aos propósitos a que se propôs. Com efeito, buscar-se-á tratar exaustivamente o instituto sob o prisma eminentemente processual, ainda que, inicialmente, algumas considerações acerca do direito material se revelem necessárias.

Abstract in English
This thesis aims to develop the topic of disregard of the legal entity, focusing on its influence before the various procedural institutes. There is a moment of need for a new delimitation of the procedural aspects of disregard doctrine. This is because, unlike the Code of Civil Procedure of 1973, the Code of Civil Procedure of 2015 (L. 13.105 / 2015) innovated in predicting the "incident of disregard of legal entity", an institute designed to regulate procedurally the disregard of legal entity. The legislator's choice to create a specific procedure reveals a concern to ensure the adversarial principle and the legal defense to the defendant in the incident, in addition to, ultimately, to assure the demands of procedural efficiency and economy. Thus, the changes undertaken by the new Brazilian procedural law will be analyzed, considering the doctrinal discussions under the old Code. Analyzing these discussions it will be possible to conclude whether the new Code, in fact, served the purposes for which it was proposed. In fact, it will be studied procedural aspects, even though, initially, some considerations about theory of disregard of legal entity may prove necessary.
