A pesquisa volta-se aos pressupostos e limites da ação anulatória de sentença arbitral, tecendo uma análise aprofundada das invalidades previstas no art. 32 da Lei n° 9.307/96 (alterado em parte pela Lei n° 13.129/15). Abordam-se a natureza jurídica dessas nulidades, definindo-as como categorias de direito material ou de direito processual, o seu caráter exemplificativo ou exaustivo, as hipóteses em que se configuram, assim como a possibilidade de, sobre elas, pairarem necessariamente princípios maiores do direito, como o respeito à Constituição Federal e à ordem pública. Nesse contexto, estuda-se, ainda, ação anulatória prevista no art. 33 da Lei de Arbitragem. Passando igualmente pela categoria da sentença inexistente e pelos vícios dos quais decorreria essa inexistência, dedica-se um capítulo também à ação declaratória de inexistência de sentença, também conhecida como querela nullitatis insanabilis ou actio nullitatis. Ao final, pretende-se tenha sido possível realizar uma análise tão minuciosa quanto profunda do tema, respondendo às várias indagações que sobre ele subsistem, com vias a encontrar um fio condutor que se preste a uma sistematização mais sólida a respeito da desconstituição da sentença arbitral.

The research explores the premises and limits of the judicial challenge to the domestic arbitration award, analyzing deeply the disability disciplined by article 32 of Law n° 9.307 / 96 (amended by Law n° 13.129 / 15). It discusses the legal status of these invalidities, defining them in the categories of civil and procedural law, their exhaustive or exemplary character, the hypothesis in which they are configured, as well as the possibility of being ruled by important principles such as the Federal Constitution and public order. In this context, it is also studied the action of judicial annulment disciplined in article 33 of the Arbitration Law. A specific chapter likewise addresses the declaratory action of nonexistence of an arbitral award, also known as the querela nullitatis insanabilis or actio nullitatis, besides exploring the category of nonexistent award and its defects. In the end, it is intended to make a thorough and in-depth analysis of the subject, answering the many questions on the subject, with the intention of finding a guiding thread that allows a more solid systematization regarding the annulment of arbitral awards.
