Abstract in English
The purpose of this dissertation was to study the appeal of interlocutory decisions rendered at first instance after the edition of the 2015's Civil Procedure Code (Law nº 13.105/2015). The paper is initiated by a historical investigation and a comparative analysis of the Portuguese, German and North American models of appeal, followed by an examination of the relationship that exists between orality, preclusion and the appeal of interlocutory decisions. Through doctrinal, jurisprudential and empirical analysis, the proposal is to investigate which means of impugnation are now available against interlocutory decisions rendered at first instance, with special focus to the extension of their admissible use, to the appeal technique chosen for each type of interlocutory decision and to the analysis of the implications and consequences arising from the changes that were promoted.
