O adequado desenvolvimento de uma teoria do crime depende da delimitação de quem é o seu sujeito ativo. A distinção entre autores e partícipes é essencial à previsibilidade das condutas que são consideradas criminosas, possibilitando deliminar a esfera da proibição criminal e a da liberdade pública. Questiona-se, assim, a teoria mais adequada para essa diferenciação e se ela é compatível com a legislação brasileira. Para esse objetivo, a teoria do domínio do fato tem se afirmado como a mais adequada, fornecendo critérios adequados para a imputação e fixação da pena pelo julgador. É importante, então, analisar se essa teoria se ade=équa à legislação brasileira e quais seriam os efeitos de sua adoção. A partir de sua aplicação, propõem-se balizas de dosimetria da pena aos autores e partícipes.

Abstract in English
The adequate development of a crime theory depends on the delimitation of who is its active subject. The distinction between authors and participants is essential to the predictability of conduct that is considered criminal, making it possible to limit the sphere of criminal prohibition and public freedom. For this purpose, the doctrine of control over the criminal act has been affirmed as the most appropriate, providing adequate criteria for the attribution and sentencing by the judge. It is therefore important to analyze whether this theory conforms to the Brazilian legislation and what the effects of its application would be. Based on its application, guidelines are proposed for applying the penalty to authors and participants.
