O instituto do Parto Anônimo é uma alternativa oferecida pelo Estado às mulheres que não desejam maternar e, também, não querem adotar a prática do abortamento voluntário. É a possibilidade de entrega do bebê para adoção sem que a identidade da genitora seja revelada, guardando seu anonimato. Alguns países já adotam o programa do Parto Anônimo, como Áustria, Bélgica, alguns Estados dos Estados Unidos, França, Itália, Luxemburgo e Japão. Na Alemanha, a entrega é de modo confidencial. O objetivo desta dissertação é centralizar o estudo na legislação nacional e estrangeira, especificamente França e Alemanha, para oferecer às gestantes brasileiras uma nova opção para evitar a prática do abortamento provocado, abandono selvagem e infanticídio. Conclui-se que com eventual implantação do Parto Anônimo, muitas mulheres em situação de desesperança, poderão procurar assistência especializada que as direcionem para uma decisão consciente, tanto pela entrega da criança, como por exercer sua maternidade, preservando físico e emocionalmente mãe e filho.

The institute of Anonymous Birth is an alternative offered by the State to women who do not wish to be mothers and also do not want to adopt the practice of voluntary abortion. It is the possibility of giving the baby up for adoption without the identity of the mother being revealed, ensuring her anonymity. Some countries already adopt the Anonymous Birth program, such as Austria, Belgium, some states of the United States, France, Italy, Luxembourg and Japan, in Germany the delivery is confidential. The objective of this dissertation is to focus the study on national and foreign legislation, specifically that of France and Germany, that offers Brazilian pregnant women a new option to avoid the practice of provoked abortion, wild abandonment and infanticide. It is concluded that with the eventual implantation of Anonymous Birth, many women in situations of hopelessness will be able to seek specialized assistance that will direct them toward a conscious decision to give up the child or to exercise motherhood, physically and emotionally preserving mother and child.
