A presente dissertação tem o propósito de realizar reflexões sobre as sanções penais e éticoprofissionais aplicadas ao profissional da Medicina. Para atingir este desiderato, realiza-se uma investigação histórica a respeito da responsabilidade médica, analisa-se as esferas de responsabilidade jurídica do médico, os Conselhos de Medicina, os Códigos e Ética Médica, examinando-se se os preceitos do Direito Administrativo Sancionador incidem nas relações entre os Conselhos de Medicina e os médicos. Realiza-se a análise da responsabilidade penal e ético-profissional do médico, verificando quais condutas são previstas no atual Código de Ética Médica - Resolução CFM n. 1931, de 17 de setembro de 2009, como infrações disciplinares e que são tipificadas pelo Direito Penal. Examina-se se o Direito Penal configura a ultima ratio na seara da responsabilização do médico ou se as sanções disciplinares aplicadas pelos Conselhos de Medicina, principalmente quanto à pena de cassação, à falta de tipicidade das sanções, e à questão da contagem do prazo prescricional, possuem consequências mais gravosas para o profissional da Medicina. Busca-se nas normas de outros Conselhos Profissionais no Brasil e no Direito Comparado alternativas jurídicas que permitam a aplicação ao médico de um sistema sancionatório ético-profissional mais justo, compatíveis com o Estado Democrático de Direito e a dignidade da pessoa humana

This work purposes to reflect about the penal and ethical-professional sanctions applied to the physician. In order to achieve this goal, a historical investigation on medical responsibility is carried out, the spheres of legal responsibility of the physician, the Councils of Medicine, the Codes and Medical Ethics are examined, examining whether the precepts of Sanctioning Administrative Law affect in the relations between the Councils of Medicine and the doctors. The analysis of the criminal and ethical-professional responsibility of the physician is carried out, verifying which conduct is foreseen in the current Code of Medical Ethics - CFM Resolution 1931, of September 17, 2009, as disciplinary infractions and that are typified by Criminal Law. It is examined whether the Criminal Law configures the ultima ratio in the area of the doctor's responsibility or if the disciplinary sanctions applied by the Medical Councils, especially regarding the sentence of cassation, the lack of typical sanctions, and the question of the prescription period, have more serious consequences for the medical professional. It is sought in the norms of other Professional Councils in Brazil and in Comparative Law legal alternatives that allow the application to the doctor of a fairer ethical-professional sanctioning system compatible with the Democratic State of Law and the dignity of the human person
