A presente pesquisa doutoral tem por objeto o estudo da categoria do desvalor da conduta no contexto de uma concepção material de crime. Com o intuito de oferecer critérios de legitimidade para a intervenção penal, a doutrina predominante tende a enfatizar a exigência de o comportamento criminalizado acarretar uma ofensa a um bem jurídico-penal, dedicando pouca atenção, por outro lado, aos atributos intrínsecos à conduta que justificam a sua relevância penal. O desvalor da conduta constitui, porém, ao lado do desvalor do resultado, uma das dimensões essenciais do crime, de modo que o caráter criminoso de um comportamento depende, também, de determinadas características da conduta em si. Embora essa percepção não seja original - já que existente desde o finalismo -, sustenta-se, nesta tese, à diferença do finalismo, que a categoria do desvalor da conduta não pode ser compreendida como um simples elenco descritivo de elementos objetivos e subjetivos relacionados ao comportamento, ou como um simples substrato, devendo ser percebida, na realidade, como um substrato valorado. Tem-se na categoria do desvalor da conduta, consequentemente, um conceito multidimensional, que apresenta, além de uma dimensão ontológica dada por componentes objetivos - como o tipo de conduta, o modo de realização do crime e sua aptidão para a produção do resultado - e subjetivos - relativos aos estados mentais que concorrem na prática do comportamento -, uma dimensão normativa que compreende o juízo de valor direcionado ao comportamento, juízo esse que pressupõe processos de interpretação, confrontação e atribuição.

The aim of this doctoral research is to study the category of conduct devaluation in the context of a substantial conception of crime. In order to provide legitimacy criteria for criminal intervention, the prevailing doctrine tends to emphasize the requirement that criminalized behavior entangles an offense to a legal good, with little regard, on the other hand, as for the intrinsic attributes regarding the conduct that justifies its criminal relevance. Nevertheless, the devaluation of conduct constitutes, along with the devaluation of the result, one of the essential dimensions of crime, so that the criminal character of a behavior likewise depends on certain characteristics of the conduct itself. Even though this perception is not original - once it has existed since finalism - it is argued in this thesis, unlike finalism, that the category of conduct devaluation should be understood as a valued substrate and not be perceived as a simple descriptive cast of objective and subjective elements related to behavior. The category of devaluation of conduct is, therefore, a multidimensional concept, which presents, in addition to an ontological dimension given by objective components - such as the type of conduct, the mode of crime and its ability to produce the result - and subjective - related to the mental states that compete in the practice of behavior - a normative dimension that comprises the value-oriented judgment toward the behaviour, which presupposes processes of interpretation, confrontation and attribution.
