Esta tese trata dos deveres de cuidado e das dimensões do risco, trazendo as contribuições da Regulação de Risco para o Direito Penal. Inicialmente, indicamos que a Teoria da Acessoriedade Administrativa apenas abarca o plano normativo da questão do risco. Sugerimos a análise do Direito Penal no contexto regulatório, conforme realizada pela common law, para o desenvolvimento de nosso tema. A interdisciplinaridade foi escolhida como método, sendo percebida como um ponto em comum entre o funcionalismo teleológico alemão, adotada no Brasil, e a Regulação de Risco. As dimensões sociocultural e técnico-científica do risco foram analisadas tanto na Regulação de Risco como no Direito Penal, a partir da estrutura dos deveres de cuidado. A Regulação de Risco foi abordada a partir de seus métodos, principalmente, a Regulação em metas e a Regulação em regras, como também a solução dada às questões da incerteza científica e do risco sistêmico. Os tópicos abordados foram escolhidos visando as possíveis consequências ao tema dos deveres de cuidado no Direito Penal. Quanto ao Direito Penal, abordamos os deveres de cuidado como instituto importado da Regulação de Risco, principalmente, quanto aos crimes de perigo abstrato, culposo e omissivos. Nesse ponto, realizamos um estudo de direito comparado funcionalista para compreendermos se e como as dimensões do risco são tratadas nessas classes de crimes, a partir dos deveres de cuidado. A análise de direito comparado deu-se entre o sistema romano-germânico e a common law.

This thesis deals with the duties of care and the dimensions of risk, referring to the contributions of the Risk Regulation to criminal law. Initially, we indicate that the "Teoria da Acessoriedade Adminsitrativa" only encompasses the normative level of risk. We suggest the analysis of "Criminal Law in the regulatory context", as performed by the common law, for the development of our topic. The interdisciplinarity was chosen as a method, being perceived as a common point between the German teleological functionalism adopted in Brazil and the Risk Regulation. The sociocultural and technical-scientific dimensions of risk were analyzed both in Risk Regulation and Criminal Law, based on the structure of duties of care. Risk Regulation was addressed based on its methods, mainly, regulation in goals and regulation in rules, as well as the solution given to the issues of scientific uncertainty and systemic risk. The topics addressed were chosen aiming at the possible consequences to the theme of the duties of care in criminal law. As for Criminal Law, we approach the duties of care as an "imported" institute of Risk Regulation, mainly regarding crimes of abstract danger, crimes with negligence and recklessness, and omissions. We conducted study based on a functionalist comparative law approach to understand if and how the dimensions of risk are treated in these classes of crimes, based on the duties of care. The comparative analysis took place between the Roman- Germanic system and the common law.
