Nesta dissertação, objetivamos analisar e problematizar, por meio da teoria da racionalidade penal moderna, um fenômeno que vem ocorrendo dentro do direito criminal referente à uma mudança de compreensão, intensificada particularmente no contexto da reforma psiquiátrica brasileira, do Sistema de Direito Criminal com relação à necessidade de aplicação de algumas garantias penais e processuais penais às medidas de segurança. Tínhamos duas hipóteses iniciais. A primeira é a de que a aplicação de garantias penais e processuais penais às medidas de segurança tem sido feita mobilizando um recurso cognitivo (a racionalidade penal moderna) que acaba reforçando um conceito de punição essencialmente hostil. A segunda hipótese é a de que os novos entendimentos em saúde mental e o fortalecimento institucional da reforma psiquiátrica brasileira produzem ressonâncias no Sistema de Direito Criminal e dentre essas ressonâncias está o entendimento que visa assegurar ao indivíduo com transtorno mental autor de um delito as mesmas garantias que regem a aplicação e execução das penas dos indivíduos considerados penalmente responsáveis. A pesquisa fora feita por meio de uma revisão bibliográfica e de uma pesquisa empírica documental realizada por meio da coleta de acórdãos do STF. Constatamos, ao final, que argumentos ligados à racionalidade penal moderna possuem para a literatura jurídica e a para o STF um papel importante na aplicação de garantias penais e processuais penais às medidas de segurança e que juristas que estão atentos à reforma psiquiátrica defendem a ampla aplicação de garantias penais e processuais penais ao indivíduo portador de transtorno mental autor de um delito. Verificamos, ainda, com a pesquisa empírica, que algumas garantias foram aplicadas pelo STF às medidas de segurança antes da emergência da reforma psiquiátrica brasileira, o que nos obriga a ter a cautela de não associar automaticamente a aplicação de garantias penais às medidas de segurança aos novos entendimentos em saúde mental.

In this dissertation, we aim to analyze and problematize, through the theory of modern criminal rationality, a phenomenon that has been occurring within the criminal law concerning a change of understanding, intensified particularly in the context of the Brazilian psychiatric reform, of the Criminal Law System in relation to The need to apply certain criminal and criminal procedural safeguards to security measures. We had two initial hypotheses. The first is that the application of criminal and criminal procedural safeguards to security measures has been done by mobilizing a cognitive resource (modern penal rationality) that reinforces an essentially hostile concept of punishment. The second hypothesis is that the new understandings in mental health and the institutional strengthening of the Brazilian psychiatric reform produce resonances in the Criminal Law System and among these resonances is the understanding that aims to assure to the individual with mental disorder author of a crime the same guarantees that govern the application and execution of the sentences of the individuals considered criminally responsible. The research was done through a bibliographical review and an empirical documentary research accomplished through the collection of STF judgments. In the end, we find that arguments related to modern criminal rationality have an important role for the legal literature and for the Supreme Court in the application of criminal and criminal procedural safeguards to security measures and that jurists who are attentive to the psychiatric reform defend the wide application of criminal and criminal procedural safeguards to the individual with mental disorder who committed a crime. We also verified with the empirical research that some guarantees were applied by the STF to the security measures before the emergency of the Brazilian psychiatric reform, which forces us to be careful not to automatically associate the application of criminal guarantees to the security measures to the new understandings in mental health.
